     A bill to amend 1978 PA 368, entitled

 

"Public health code,"

 

(MCL 333.1101 to 333.25211) by adding sections 2755 and 2757.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 2755. The department shall do all of the following:

 

     (a) Determine and designate the areas of the state that are

 

critical needs areas for primary health care in which scholarship

 

recipients may engage in a designated frontline health practice in

 

order to fulfill their contractual obligation.

 

     (b) Determine and designate the areas of the state that are

 

critical needs areas for primary health care in which loan

 

repayment grant recipients may engage in a designated frontline

 

health practice in order to fulfill their contractual obligation.

 

     (c) Determine the priority of additional primary health care

 


practioners who are eligible to participate in the loan repayment

 

grant program using any national health service corps matching

 

funds or other money other than money appropriated by the

 

legislature.

 

     Sec. 2757. (1) The department may award a scholarship under

 

this section to an individual determined by the department to meet

 

all of the following eligibility criteria:

 

     (a) Is enrolled in or been accepted into a qualified state

 

school.

 

     (b) Has signed a written scholarship agreement with the

 

department that contains the terms and conditions of the

 

scholarship award. The agreement shall include the recipient's

 

agreement to engage in a designated frontline health practice for

 

at least 3 years after completion of his or her residency, or

 

graduation, as applicable, in an area of the state that is a

 

critical needs area for primary health care at the time of the

 

recipient's entry into the designated frontline health practice.

 

     (c) Has resided continuously in this state for the 12 months

 

immediately preceding the date of his or her application and is not

 

a resident of any other state.

 

     (d) Has not been convicted of a felony involving an assault,

 

physical injury, or death.

 

     (e) Meets any other standards established in rules promulgated

 

by the department.

 

     (2) A scholarship awarded by the department under this part

 

shall be in an amount that will pay the full cost of attendance at

 

the qualified state school in which the recipient is enrolled, as

 


determined by the department, for the entire time necessary for the

 

recipient to complete the requirements for a degree from that

 

school.

 

     (3) If a scholarship recipient leaves a qualified state school

 

before graduation, leaves his or her residency before completion,

 

if applicable, or fails to engage in a designated frontline health

 

practice for a period of 3 years in a critical needs area for

 

primary health care designated in his or her scholarship agreement,

 

he or she must repay all of the scholarship money he or she

 

received under this section to the department. The amount he or she

 

is obligated to repay under this subsection is due and payable,

 

with interest at the rate established by the department under

 

section 2761, within 90 days.

 

     Enacting section 1. This amendatory act does not take effect

 

unless all of the following bills of the 96th Legislature are

 

enacted into law:
