CDL REVISIONS H.B. 5936 (H-1):
FLOOR SUMMARY
House Bill 5936 (Substitute H-1 as passed by the House)
Sponsor: Representative Holly Hughes
House Committee: Military and Veterans Affairs and Homeland Security
CONTENT
The bill would amend the Michigan Vehicle Code to do allow the Secretary of State (SOS) to waive a driving skills test required for an original vehicle group designation and passenger indorsement for a person with military commercial motor vehicle (CMV) experience, if the person certified and provided evidence that he or she continuously met certain Federal requirements within two years before the date of application for the commercial driver license (CDL).
The bill also would do the following:
-- Extend to a commercial learner's permit provisions prohibiting the SOS from issuing, and allowing the SOS to cancel, a vehicle group designation or indorsement under certain circumstances.
-- Refer to an applicant's disqualification from operating a CMV due to improper testing, as well as fraudulent testing, in the conditions that preclude issuance and allow a cancelation.
-- Require the SOS to require an applicant to retake and successfully pass a required knowledge or driving skills test if the SOS determined, through a government investigation, that there was reason to believe that a CDL or endorsement was issued as a result of fraudulent or improper conduct when the original test was taken.
-- Require the SOS to cancel any CDL or endorsement issued as a result of the suspect test unless the applicant retook and passed it.
