Sponsor: Representative Eileen Kowall
House Committee: Natural Resources, Tourism, and Outdoor Recreation
Senate Committee: Natural Resources, Environment and Great Lakes

Date Completed: 12-12-11

CONTENT
The bill would repeal Section 3111 of the Natural Resources and Environmental Protection Act, which requires a person doing business in Michigan to file an annual report with the Department of Environmental Quality (DEQ) if the person discharges to the waters of the State or to any sewer system wastewater that contains waste in addition to sanitary sewage.

The report must set forth the nature of the enterprise, indicating the quantities of materials used in and incidental to its manufacturing processes and including by-products and waste products that appear on a register of critical materials compiled by the DEQ. The report also must include the estimated annual total number of gallons of wastewater, including process and cooling water to be discharged to the State's waters or to any sewer system. A business's or industry's operations that violate Section 3111 may be enjoined by an action commenced by the Attorney General.
