CONTENT

 

The bill would amend the Mobile Home Commission Act to do the following:

 

 --    Require the Mobile Home Code Commission to promulgate rules requiring a mobile home park owner to post security for the cleanup of the park.

 --    Require an owner to comply with those rules in order to secure or renew a license to operate a mobile home park.

 

Specifically, within one year after the bill's effective date, the Mobile Home Code Commission would have to promulgate rules to require the owner of a mobile home park or seasonal mobile home park to post security for the cleanup of the park, including the removal and disposal of abandoned mobile homes, scrap material, and waste.  The rules would have to provide for security in the form of a bond, cash deposit, or other financial instrument.

 

The Act prohibits a person from operating a mobile home park or seasonal mobile home park without a license.  The Department of Licensing and Regulatory Affairs must grant a license upon completion, review, and approval of certifications.  A three-year license must be granted and renewed based upon the certifications and recommendations of the appropriate agencies and local governments.

 

Under the bill, the Department would have to grant and renew a three-year license to operate a mobile home park or seasonal mobile home park upon approval of the certifications and recommendations of the appropriate agencies and local governments, as well as the owner's compliance with the rules required to be promulgated under the bill.

FISCAL IMPACT

 

The bill would introduce some small, one-time costs associated with rule promulgation to the Department of Licensing and Regulatory Affairs.  Verification of security posted by owners of mobile home parks could be done during the license renewal process so it would likely add little in terms of ongoing costs.  The one-time costs would be borne by existing Department resources.
