CONTENT
The bill amended the Corrections Code to require the Department of Corrections, upon the request of a victim or a victim's representative, to confiscate and dispose of any of the following that are in a prisoner's possession:
-- Any item that belongs to the victim or formerly belonged to the victim.
-- A photograph, drawing, or other visual image or representation of the victim.
The bill defines "victim's representative" as either of the following:
-- The victim's parent or legal guardian, if the victim is under 18 years of age.
-- A member of the victim's immediate family or, if there is no immediate family member, the victim's next of kin, if the victim is deceased or otherwise unable to exercise his or her rights under the bill.
The bill took effect on January 9, 2013.
