CONTENT

 

The bill would amend the Weights and Measures Act to revise provisions regulating the display of the grade of fuel being sold at a roadside retail location and the price for that fuel.

 

Beginning July 2, 2013, the Act will require the price advertised for motor fuel sold at a roadside retail location to include the grade of fuel being sold, with certain labels or abbreviations for the grade of fuel.  The bill specifies that the requirement would not preclude the owner or operator of a business selling motor fuels at a roadside retail location from using a proprietary fuel name.

 

Also, beginning July 2, 2013, if the advertised price of motor fuel sold at a roadside retail location is subject to one or more conditions for sale at that price, the retailer will have to post the conditions immediately adjacent to the sales price with equal illumination in lettering of the same style and of at least one-half the size that is used to post the sale price.  Under the bill, that requirement would apply to conditions of sale other than payment by cash or credit card.  The requirement also would apply to conditions regarding payment by cash or credit card beginning on July 2, 2017.

 

In addition, beginning July 2, 2013, if the unit price for the same grade of motor fuel differs, all prices must be displayed in lettering of the same style and size.  Under the bill, if the unit price for the same grade of motor fuel differed, and the sign would not accommodate displaying all prices in lettering of the same style and size, the highest price would have to be displayed in lettering using the largest size of the prices that were displayed.
