CONTENT
The bill would amend the Michigan Vehicle Code to include in the definition of "special mobile equipment" a generator trailer and a portable conveyor, and exempt a portable conveyor from the Code's brake requirements.
The Code defines "special mobile equipment" as every vehicle not designed or used primarily for the transportation of people or property and incidentally operated or moved over the highways. The definition includes a number of specific types of vehicles, and provides that the enumeration must be considered partial and does not exclude other vehicles within the general terms of the definition. The bill would include generator trailers used exclusively to generate power and portable conveyors among the specified vehicles.
(Special mobile equipment is exempt from the Code's general registration and certificate of title provisions, but the Secretary of State may issue a special registration to an individual, partnership, corporation, or association not licensed as a dealer that pays the required fee to identify special mobile equipment that is driven or moved on a street or highway. The Code requires special mobile equipment to be identified with a reflective device, and prohibits operation of equipment with certain types of tires. A driver or owner of any special mobile equipment who fails to stop at or bypasses any scales or weighing station is guilty of a misdemeanor.)
The Code prescribes brake requirements for different types of motor vehicles, trailers, and semi-trailers. The bill provides that nothing in the Code or rules promulgated under it would require a portable conveyor of lawful axle weight to be equipped with brakes.
