Senate Bill 713 (Substitute S-1 as reported by the Committee of the Whole)
Sponsor: Senator Mike Nofs
Committee: Regulatory Reform

CONTENT
The bill would amend Public Act 350 of 1917, which regulates and provides for the local licensure of second hand goods and junk dealers, to exclude from the definition of "second hand dealer" or "junk dealer" a retail store or business that deals primarily in the purchase and resale of second hand clothing, children's furniture and equipment, children's toys, musical instruments, or sporting goods (but not firearms).

The bill also would prohibit a city, county, or village from regulating, as a "second hand dealer" or "junk dealer", a person excluded from the definition of those terms as described above, or requiring such a person to obtain a license to carry on its business in that city, county, or village.

FISCAL IMPACT
The bill would reduce local unit revenue and expense by an unknown, and likely negligible amount. License fees are required to be based on the cost of issuing and administering the license. By exempting certain businesses from the requirements of the Act, the bill would reduce both license revenue and administrative expenses.

The bill would have no impact on State revenue or expenditures.
