A SUMMARY OF HOUSE BILL 5363 AS INTRODUCED 2-7-23
The bill would amend Part 115 (Solid Waste Management) of the Natural Resources and Environmental Protection Act to exclude soil from sugar beet production from the definition of solid waste.
Specifically, the bill would add "soil washed or otherwise removed from sugar beets" to the list of materials that are not considered solid waste under Part 115.
Under Part 115, "solid waste" means garbage, rubbish, ashes, incinerator ash or residue, street cleanings, municipal and industrial sludges, solid commercial and industrial waste, and animal waste other than organic waste generated in the production of livestock and poultry.
