A SUMMARY OF HOUSE BILL 4037 AS INTRODUCED 1-13-12

Generally speaking, Section 627 of the Michigan Vehicle Code describes how speed limits are to be established.  House Bill 4037 would provide an exception and specify that a speed limit that was posted as of November 9, 2006, in a residence district on a dirt or gravel road located in a city, village, or township is effective unless the city or village council or township board requests the county road commission to change the speed limit within that posted area and the speed limit is re-established as provided for in the act.

The bill would define "residence district" to mean that term as defined in former Section 51 of the Vehicle Code.  That now-repealed section defined residence district as "the territory contiguous to a highway not comprising a business district when the frontage on such highway for a distance of 300 feet or more is mainly occupied by dwellings or by dwellings and buildings in use for business."
