A SUMMARY OF HOUSE BILLS 4029-4031 AS INTRODUCED 1-13-11
The bills would amend various laws to allow for single-member county road commission districts. The bills are tie-barred to each other, meaning none would take effect unless all are enacted.
House Bill 4031 would amend the County Road Law to permit a county board of commissioners, in a county where county road commissioners are elected, to pass a resolution providing for single-member districts for road commissioners. Within 60 days after adoption of a resolution, the County Apportionment Commission would have to establish districts equal to the number of road commissioners to be elected.
House Bill 4029 would amend Public Act 261 of 1966, which deals with apportionment of county boards of commissioners, to specify that the duties of a county apportionment commission would include establishing single-member county road commission districts.
House Bill 4030 would amend the Michigan Election Law to require a person representing a single-member county road commission to be a resident of the district. The bill also would specify that petitions signed by electors residing in the district would have to be filed with the county clerk for a person to become a candidate for nomination by a political party; that a vacancy would occur if a road commissioner moved out of the district; and that a person from the district would be appointed by the county board of commissioners to fill any vacancy.
