Rep. Barb Byrum, from the 67th District, offered the following invocation:

“If I knew you and you knew me,

If both of us could clearly see;

And with an inner sight divine

The meaning of your heart and mine,

I’m sure that we would differ less,

And clasp our hands in friendliness;

Our thoughts would pleasantly agree

If I knew you and you knew me.

We are a family, here in the Legislature. Let us remember our sister, Representative Lisa Howze as her father, John Morgan, passed away last Thursday and his funeral was this morning.

Let us also keep our brother, Representative Daley and his wife, Debbie, in our hearts, during their time of mourning. Last night their son, Thomas, the youngest of their three children went to be with the Lord. Thomas was a mere 23 years old. Like his father he had the gift to light up the room with one step. Thomas had such a kind natured spirit and was surrounded by more than thirty family members when he went to be with the Lord. May we all keep the Daley family in our hearts and strive to keep our family close.

Let us remember that each day is a gift and we must cherish every moment.

Please join me in a moment of silence to reflect and ask for healing for those that are in pain.

Thank you.”

Rep. Lund moved that Reps. Daley and Gilbert be excused from today’s session.

Comments and Recommendations

Rep. Stamas moved that Rule 17 be suspended.

The motion prevailed, 3/5 of the members present voting therefor.

Rep. Stamas moved that the following remarks be printed in the Journal.

The motion prevailed.

Rep. Kurtz:

“Mr. Speaker, I rise to ask for our thoughtful consideration and prayers for the family of a colleague of this chamber, Representative Kevin Daley.

As most of us have experienced who have been here for any length at all, the relationships we establish here are very secure and will be long lasting.

Mr. Speaker, many of us here in this chamber are dependent on family to carry on responsibilities at home while we serve the people of our districts and the people of this great state. They do this because they respect and value what we do. When Representative Daley came here to serve, his son, then 21, Thomas stepped into care for the duties of the family farm, which had been in their family for generations. Thomas was so very proud to follow in his father’s footsteps, and many of us had met him.

This past Sunday morning, while with his father and a friend, Thomas was struck by a falling tree. The injuries he sustained were very extensive. He did not regain consciousness and last night at 9:45 PM, Thomas succumbed to those injuries and passed from this life to his eternal home.

Mr. Speaker, I would like us to remember Representative Daley, his family, friends and also his colleagues here as we mourn the loss with him. Thank you.”

Rep. Nathan:

“Thank you Mr. Speaker, if you don’t mind, I’d like to say a few words about Representative Daley’s son. I had the opportunity to meet Representative Daley’s son, Thomas, a year ago. I went out to their farm and I purchased some beef, from Representative Daley. He is a dairy farmer as you all know and he has some good beef. But, I had the opportunity to meet his son, who had taken on the responsibility, as the representative said, of taking care of the farm while his father served his community. The young man was a very nice and polite young man and he kept the dog away from me as I was coming up to the house. But I just wanted to say my prayers to the family of Representative Daley in a time of grief. Keep their family in your prayers. Thank you.”

By unanimous consent the House returned to the order of

Motions and Resolutions

By unanimous consent the House considered House Resolution No. 18 out of numerical order.

Reps. O’Brien, Constan, Crawford, Goike, Heise, Horn, Huuki, LeBlanc, MacMaster, Poleski, Slavens and Tyler offered the following resolution:

House Resolution No. 18.

A resolution to declare February 6, 2011, as Ronald Reagan Day in the state of Michigan.

Whereas, President Ronald Wilson Reagan, a man of humble background, worked throughout his life serving freedom and advancing the public good, having been employed as an entertainer, union leader, corporate spokesman, governor of California and President of the United States; and

Whereas, Ronald Reagan served with honor and distinction for two terms as the 40th President of the United States of America; the second of which he earned the confidence of 3/5 of the electorate and was victorious in 49 of the 50 states in the general election, a record unsurpassed in the history of American presidential elections; and

Whereas, In 1981, when Ronald Reagan was inaugurated as President, he inherited a disillusioned nation shackled by rampant inflation and high unemployment; and

Whereas, During Mr. Reagan’s presidency, he worked in a bipartisan manner to enact his bold agenda of restoring accountability and common sense to government which led to an unprecedented economic expansion and opportunity for millions of Americans; and

Whereas, Mr. Reagan’s commitment to an active social policy agenda for the nation’s children helped lower crime and drug use in our neighborhoods; and

Whereas, President Reagan’s commitment to our armed forces contributed to the restoration of pride in America, her values and those cherished by the free world, and prepared America’s armed forces to meet 21st century challenges; and

Whereas, President Reagan’s vision of “peace through strength” led to the end of the Cold War and the ultimate demise of the Soviet Union, guaranteeing basic human rights for millions of people; and

Whereas, February 6, 2011, will be the 100th anniversary of Ronald Reagan’s birth, and the seventh since his passing; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body declare February 6th, 2011, as Ronald Reagan Day in the state of Michigan.

The question being on the adoption of the resolution,

The resolution was adopted.

______

Rep. Stamas moved that House Committees be given leave to meet during the balance of today’s session.

The motion prevailed.

Rep. Stamas moved that when the House adjourns today it stand adjourned until Tuesday, February 8, at 1:30 p.m.

The motion prevailed.

Reps. Pettalia, Franz, Tyler, Huuki, Crawford, Forlini, Walsh, Callton, Olson, Somerville, Shirkey, Poleski, MacGregor, Foster, Rendon, LaFontaine, Shaughnessy, MacMaster, Outman, Goike, Ouimet, Wayne Schmidt, Bumstead, McBroom, Yonker, Heise, Horn, Johnson and LeBlanc offered the following resolution:

House Resolution No. 17.

A resolution to express opposition to the possible ban of firearm hunting and snowmobiling in certain areas of the Huron-Manistee National Forest.

Whereas, In compliance with a U.S. Sixth Circuit Court of Appeals decision, the U.S. Forest Service is revisiting its 2006 Land and Resource Management Plan for the Huron-Manistee National Forest. Currently, the Forest Service allows firearm hunting and snowmobiling in all of the forest. However, a Michigan attorney has sued the Forest Service in an effort to stop firearm hunting and snowmobiling in all primitive areas and semi-primitive non-motorized management areas; and

Whereas, The 2006 Land and Resource Management Plan was available for and received extensive public comment before being implemented. Yet the public’s access to 70,000 acres of public land is being threatened by one individual’s preference; and

Whereas, The desire to pursue quiet recreational activities in the primitive and semi-primitive areas of the forest does not preclude hunting. Many hunters enjoy the quiet and solitude of the forest when hunting. Additionally, snowmobiles operating in a forest of this size rarely impose on the enjoyment of the forest by others. Given the size of the forest, a snowmobile operator can ride many miles without ever encountering another person and it is likely that others enjoying the forest in winter would not encounter a snowmobile;

Whereas, The Federal Land Policy and Management Act provides the Forest Service the authority to determine where hunting may or may not occur on public lands. This authority should be left to the Forest Service, rather than the political bias of individuals. Wildlife managers and experts should have the final say in how the public land is used; now, therefore, be it

Resolved by the House of Representatives, That we oppose the possible ban of firearm hunting and snowmobiling in certain areas of the Huron-Manistee National Forest; and be it further

Resolved, That copies of this resolution be transmitted to the Chief of the U.S. Forest Service and the members of the Michigan congressional delegation.

The resolution was referred to the Committee on Natural Resources, Tourism, and Outdoor Recreation.
