“An act to provide for the registration, titling, sale, transfer, and regulation of certain vehicles operated upon the public highways of this state or any other place open to the general public or generally accessible to motor vehicles and distressed vehicles; to provide for the licensing of dealers; to provide for the examination, licensing, and control of operators and chauffeurs; to provide for the giving of proof of financial responsibility and security by owners and operators of vehicles; to provide for the imposition, levy, and collection of specific taxes on vehicles, and the levy and collection of sales and use taxes, license fees, and permit fees; to provide for the regulation and use of streets and highways; to create certain funds; to provide penalties and sanctions for a violation of this act; to provide for civil liability of owners and operators of vehicles and service of process on residents and nonresidents; to provide for the levy of certain assessments; to provide for the enforcement of this act; to provide for the creation of and to prescribe the powers and duties of certain state and local agencies; to impose liability upon the state or local agencies; to provide appropriations for certain purposes; to repeal all other acts or parts of acts inconsistent with this act or contrary to this act; and to repeal certain parts of this act on a specific date,”

A bill to amend 2007 PA 36, entitled “Michigan business tax act,” by amending section 267 (MCL 208.1267).

Was read a second time, and the question being on the adoption of the proposed amendment previously recommended by the Committee on Tax Policy (for amendment, see House Journal No. 94, p. 2182),

The amendment was adopted, a majority of the members serving voting therefor.

Rep. McMillin moved to amend the bill as follows:

1. Amend page 1, line 4, after “(5)” by inserting “OR (6)”.

2. Amend page 3, following line 5, by inserting:

(6) NOTWITHSTANDING SUBSECTION (1), A FINANCIAL INSTITUTION MAY ELECT TO HAVE ITS BUSINESS ACTIVITIES THAT ARE SUBJECT TO TAX BOTH WITHIN AND OUTSIDE THIS STATE APPORTIONED TO THIS STATE BY MULTIPLYING ITS TAX BASE BY THE SAME SALES FACTOR UTILIZED BY A TAXPAYER THAT QUALIFIES UNDER SUBSECTION (5) TO CALCULATE ITS SALES FACTOR IN ACCORDANCE WITH SECTION 307.”.

Rep. McMillin, having reserved the right to explain his protest against the passage of the bill, made the following statement:

“Mr. Speaker and members of the House:

I voted ‘no’ because this bill gives a tax advantage for one bank over all other banks in the state. That one bank was also the recipient of $5 billion of TARP money. The state should not be picking winners and losers like this. All banks should have a level playing field.”

(2) FOR THE STATE FISCAL YEAR COMMENCING OCTOBER 1, 2009 AND ANNUALLY THEREAFTER, THERE SHALL BE DEDUCTED FROM ANY AMOUNT TO BE ASSESSED UNDER SUBSECTION (1) AN AMOUNT EQUAL TO THE DIFFERENCE BY WHICH THE ACTUAL EXPENDITURES OF THE COMMISSION ATTRIBUTABLE TO EXERCISING ITS DUTIES UNDER THIS ACT FOR THE PREVIOUS FISCAL YEAR ARE LESS THAN THE AMOUNT ASSESSED AGAINST EACH VIDEO SERVICE PROVIDER IN THE PREVIOUS FISCAL YEAR. THE DEDUCTIONS SHALL BE MADE IN THE SAME PROPORTION AS THE ORIGINAL ASSESSMENT IN SUBSECTION (1).

(3) ALL MONEY PAID INTO THE STATE TREASURY BY A VIDEO SERVICE PROVIDER UNDER SUBSECTION (1) SHALL BE CREDITED TO A SPECIAL ACCOUNT, TO BE UTILIZED SOLELY TO FINANCE THE COST TO THE COMMISSION OF EXERCISING ITS DUTIES UNDER THIS ACT.”.

A resolution declaring December 1, 2009, as World AIDS Day in the state of Michigan.

Whereas, December 1, 2009, has been designated as World AIDS Day; and

Whereas, World AIDS Day provides opportunities to focus on the existing concerns and policies affecting the global fight against HIV and AIDS. It also draws attention to the massive impact that HIV and AIDS has on our community; and

Whereas, The United Nations Program on HIV and AIDS annually observes December 1 as World AIDS Day, a day to increase and reinforce the universal effort to end the proliferation of HIV and AIDS and to bring awareness to the global intricacies we face; and

Whereas, In 2007 there were 2.7 million new HIV infections and 2 million HIV-related deaths worldwide; and

Whereas, Globally, there were an estimated 33 million people living with HIV in 2007; and

Whereas, The current reported prevalence of HIV/AIDS in Michigan is 14,187; and

Whereas, This year’s World AIDS Day theme is “Universal Access and Human Rights”; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body declare December 1, 2009, as World AIDS Day in the state of Michigan.

Senate Concurrent Resolution No. 23.

Where these changes require the force of law, they must be set forth in executive orders that are submitted to the Legislature. The Legislature shall have 60 calendar days of a regular session to disapprove each executive order by a resolution concurred in by a majority of the members elected and serving in each house of the Legislature; and

Whereas, Governor Granholm has issued an executive order proposing the reorganization of the executive branch through the creation of the Department of Natural Resources and Environment; the abolishment of the Department of Environmental Quality and the Department of Natural Resources; and the reorganization of responsibilities among the Department of Agriculture, the Department of Energy, Labor, and Economic Growth, and the Department of Treasury.
