A bill to amend 1961 PA 236, entitled
"Revised judicature act of 1961,"
by amending sections 503, 504, 515, 523, 532, 537, and 549h (MCL
600.503, 600.504, 600.515, 600.523, 600.532, 600.537, and
600.549h), section 504 as amended by 2002 PA 715, section 537 as
amended by 1988 PA 134, and section 549h as added by 1990 PA 54.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 503. (1) The second judicial circuit consists of the
county of Berrien and, except as provided in subsection (2), has 4
judges.
(2) Subject to section 550, this circuit shall have 3 judges
during the period beginning 12 noon, January 1, 2013 and ending 12
noon, January 1, 2019. The judgeship temporarily eliminated from
this circuit during the period of January 1, 2013 to January 1,
2019 shall be the judgeship of a judge who is not eligible to run
for reelection due to constitutional limitation on the effective
date of the amendatory act that added this subsection.
Sec. 504. (1) The third judicial circuit consists of the
county
of Wayne and, except as provided
in subsection (2), has the
following
number of judges:
(a)
Until 12 noon, January
1, 2003, 64 judges.
(b)
Beginning 12 noon, January
1, 2003, 63 judges; however,
if,
after 12 noon, January
1, 2003, a vacancy occurs in a
judgeship
held
by an incumbent judge of this circuit who would be ineligible
to
seek reelection to that office in 2004, that judgeship is
eliminated
unless the total number of judgeships in this circuit
has
been reduced to 61 before that vacancy occurred.
(c)
Beginning 12 noon, January
1, 2005, 61 judges.
(2) Subject to section 550, this circuit shall have 60 judges
during the period beginning 12 noon, January 1, 2013 and ending 12
noon, January 1, 2019. The judgeship temporarily eliminated from
this circuit during the period of January 1, 2013 to January 1,
2019 shall be the judgeship of a judge who is not eligible to run
for reelection due to constitutional limitation on the effective
date of the amendatory act that added this subsection.
Sec. 515. (1) The fourteenth judicial circuit consists of the
county of Muskegon and, except as provided in subsection (2), has 4
judges.
(2) Subject to section 550, this circuit shall have 3 judges
during the period beginning 12 noon, January 1, 2013 and ending 12
noon, January 1, 2019. The judgeship temporarily eliminated from
this circuit during the period of January 1, 2013 to January 1,
2019 shall be the judgeship of a judge who is not eligible to run
for reelection due to constitutional limitation on the effective
date of the amendatory act that added this subsection.
Sec. 523. (1) The twenty-second judicial circuit consists of
the county of Washtenaw and, except as provided in subsection (2),
has 5 judges.
(2) Subject to section 550, this circuit shall have 4 judges
during the period beginning 12 noon, January 1, 2013 and ending 12
noon, January 1, 2019. The judgeship temporarily eliminated from
this circuit during the period of January 1, 2013 to January 1,
2019 shall be the judgeship of a judge who is not eligible to run
for reelection due to constitutional limitation on the effective
date of the amendatory act that added this subsection.
Sec. 532. (1) The thirty-first judicial circuit consists of
the county of St. Clair and, except as provided in subsection (2),
has 3 judges.
(2) Subject to section 550b, this circuit shall have 2 judges
during the period beginning 12 noon, January 1, 2013 and ending 12
noon, January 1, 2019. The judgeship temporarily eliminated from
this circuit during the period of January 1, 2013 to January 1,
2019 shall be the judgeship of a judge who is not eligible to run
for reelection due to constitutional limitation on the effective
date of the amendatory act that added this subsection.
Sec. 537. (1) The thirty-sixth judicial circuit consists of
the county of Van Buren and, except as provided in subsection (2),
has
1 judge 2 judges. Subject to section 550, this judicial circuit
may
have 1 additional judge effective January 1, 1989.
(2) Subject to section 550, this circuit shall have 1 judge
during the period beginning 12 noon, January 1, 2013 and ending 12
noon, January 1, 2019. The judgeship temporarily eliminated from
this circuit during the period of January 1, 2013 to January 1,
2019 shall be the judgeship of a judge who is not eligible to run
for reelection due to constitutional limitation on the effective
date of the amendatory act that added this subsection.
Sec.
549h. (1) If the county of Barry approves the reformation
of
the fifth judicial circuit pursuant to law, and the county of
Eaton
approves the creation of the fifty-sixth judicial circuit
pursuant
to law, the The fifty-sixth judicial circuit consists of
the county of Eaton and, except as provided in subsection (2), has

judge effective January 1, 1991. Subject to section 550, this
judicial
circuit may have 1 additional judge effective January 1,
1991.
2 judges.
(2) Subject to section 550, this circuit shall have 1 judge
during the period beginning 12 noon, January 1, 2013 and ending 12
noon, January 1, 2019. The judgeship temporarily eliminated from
this circuit during the period of January 1, 2013 to January 1,
2019 shall be the judgeship of a judge who is not eligible to run
for reelection due to constitutional limitation on the effective
date of the amendatory act that added this subsection.
