     A bill to amend 1979 PA 94, entitled

 

"The state school aid act of 1979,"

 

(MCL 388.1601 to 388.1772) by adding section 93.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 93. (1) If this state receives funds for the purposes of

 

this section from the federal incentive grant program created under

 

sections 14005 and 14006 of title XIV of the American recovery and

 

reinvestment act of 2009, Public Law 111-5, known as the "race to

 

the top" grant program, then those funds are appropriated to the

 

department to establish and implement a grant program for districts

 

as described in subsection (2).

 

     (2) If the department receives funding as described in

 

subsection (1), the department shall establish and implement a

 


competitive grant program for districts that will enable a

 

recipient district to implement a teacher performance evaluation

 

system designed to ensure that evaluations measure a teacher's

 

effectiveness in promoting student achievement, with evaluation

 

processes and standards to further this goal. The grant program

 

shall require teacher performance evaluations to be based primarily

 

on objective evidence of student learning and student improvement,

 

which shall include at least student assessment results and a

 

measure of comparative student performance and improvement in the

 

context of the demographics of the teacher's students.

 

     (3) Notwithstanding section 17b, payments to eligible

 

districts under this section shall be paid on a schedule determined

 

by the department.
