     A bill to amend 1931 PA 328, entitled

 

"The Michigan penal code,"

 

(MCL 750.1 to 750.568) by adding section 543l.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 543l. (1) A person shall not do any of the following

 

knowing that an individual is in this country illegally:

 

     (a) Transport the individual for the purpose of allowing the

 

individual to submit an application to obtain an identity document.

 

     (b) Provide any document to the individual that he or she

 

knows is false, altered, or illegally obtained for the purpose of

 

allowing the individual to submit an application to obtain an

 

identity document.

 

     (c) Do any act with the intent to conceal the fact that the

 

individual is in possession of any false, altered, or illegally

 


obtained identity document.

 

     (d) As an employee or agent of a governmental entity, issue an

 

identity document to the individual based upon any document he or

 

she knows is false, altered, or illegally obtained.

 

     (2) An individual who is in the country illegally shall not do

 

any of the following:

 

     (a) Obtain or attempt to obtain an identity document using any

 

document that he or she knows is false, altered, or illegally

 

obtained.

 

     (b) Make any statement to an employee or agent of a

 

governmental entity that he or she knows is false or misleading to

 

obtain an identity document.

 

     (c) Possess an identity document obtained in violation of this

 

section.

 

     (3) A person who violates this section is guilty of a felony

 

and shall be punished by imprisonment for not less than 1 year or

 

more than 5 years and shall be fined not less than $500.00 or more

 

than $5,000.00.

 

     (4) As used in this section, "identity document" means either

 

of the following:

 

     (a) A license to operate a motor vehicle.

 

     (b) An official state identity card.
