House Bill 5698 (Substitute H-1 as passed by the House)
Sponsor: Representative Vicki Barnett
House Committee: Intergovernmental and Regional Affairs
Senate Committee: Local, Urban and State Affairs
Date Completed: 3-8-10
CONTENT
The bill would amend the Land Division Act to replace references to the State Treasurer with references to the Director of the Department of Energy, Labor, and Economic Growth (DELEG). The bill would make this change in provisions that govern the process of plat approval and recording, including provisions that require various documents to be forwarded to the State Treasurer, and require the State Treasurer to review an approved plat for adherence to the Act.
The bill also would refer to the DELEG Director, rather than the State Treasurer, in provisions that govern circuit court actions to vacate, correct, or revise a recorded plat, and require the State Treasurer to maintain a permanent file of plats.
MCL 560.102 et al.
BACKGROUND
Executive Reorganization Order 1980-1 transferred all powers, functions, and responsibilities of the State Treasurer under the Subdivision Control Act (now called the Land Division Act) to the Department of Commerce, which has been replaced by the Department of Energy, Labor, and Economic Growth. The Bureau of Construction Codes in DELEG presently is responsible for the administration of the Land Division Act.
