A SUMMARY OF HOUSE BILL 6167 AS INTRODUCED 5-14-10

The bill would create a new act to require certain property owners to provide security measures for abandoned commercial property. 

Under the bill, the owner of an abandoned commercial property would be required to retain, at owner expense, a private security guard agency licensed under the Private Security Business and Security Alarm Act to protect the property against vandalism, trespass, and illegal activity on the premises.

The bill would define "abandoned commercial property" to mean a commercial property containing a structure that is vacant or dilapidated or is open to trespass.  "Commercial Property" would be defined to mean that term as defined in Section 2 of the Obsolete Property Rehabilitation Act (at MCL 125.272).  Generally speaking, that definition refers to buildings and improvements to land used as part of commercial business enterprises.  The term does not include land or the property of a public utility.

FISCAL IMPACT:

The bill would not appear to have any direct state or local fiscal impact.
