REVISIONS TO SCHOOL AID ACT

A SUMMARY OF HOUSEBILL 5636 SUBSTITUTE H-1:

HB 5636 (H-1) would amend the State School Aid Act to do the following:

           

o                    Amend Section 11 to appropriate any funds received by the State from the federal American Recovery and Reinvestment Act (ARRA) Race to the Top program.

o                    Amend Section 94a regarding the Center for Educational Performance and Information (CEPI) to require that CEPI in cooperation with the Department of Education, create and implement a teacher identifier system that will match individual teachers to individual pupils.  It would require that the system include access to pupil education assessment data, connect student achievement data to teachers, allow access to the data to school boards, teachers and administrators to improve instruction and student achievement and allow administrators access to pupil demographic data to identify learning challenges faced by pupils and instruction challenges faced by teachers.

o                    Create Section 166c to address basic instructional supplies shortages by the following:

·                                             Requiring that a district or intermediate school district (ISD) ensure that all teachers and principals have access to basic instructional supplies as defined by the Department of Education. 

·                                             Requiring that the Department create a system for teachers and principals to file claims if a district or ISD fails to provide basic instructional supplies. 

·                                             Allowing the Department to investigate such claims and to make available an interim amount of supplies for a classroom with a shortage and allowing the Department to prioritize claims based on need if there are insufficient resources to address all claims.

·                                             Requiring that if the State receives federal ARRA Race to the Top funding and if a portion of that funding is appropriated for this purpose, that the Department shall create a revolving fund to procure supplies for teachers who have filed claims under this section.  The Department shall order the district or ISD to repay the fund no later than the following fiscal year.  If the district or ISD fails to repay the fund, the Department shall deduct an equal amount from the district's state aid payment and deposit it into the fund.

·                                             Prohibiting a district or ISD from punishing a teacher or principal who files a claim under this section.
