Rep. Fulton Sheen, from the 88th District, offered the following invocation:

“Lord You wield great resources and provision at Your command. You release and bestow them on whom You choose. The world’s systems have done all they can to maintain the balance of power, to protect themselves and play one against another. These are the intrigues of men. These things happen in the dark of the night with a cloak of secrecy. Men arrogantly believe that they are in control and that no eye sees them, no ear hears them, and no mind perceives what they do. They do not even consider that You are ever seeing, ever hearing, and that You not only perceive their minds, but You know their thoughts and the motivations of their hearts.

America has chosen their next president and the intrigues of men are in full swing. Even now the balance of power is shifting and decisions and actions are being made and taken. Lord too many of our citizens sit unaware and oblivious to what is going on in the earth. Insulated and consumed by trivial concerns of schedules, activities, entertainment, and the business of life, they neither care, nor perceive the times in which they are living.

Lord let us embrace, engage, and discern the moment, for there is a battle going on. Let us not take lightly what is transpiring all around us; let us not be unaware or complacent.

Freedom is not free. You paid a price to set us free from sin and darkness, just as a price is paid for the nations of the earth to retain their sovereignty. A people who are unwilling to fight for their freedom will be overcome, but a people willing to fight for their freedom will not be overcome. There is a time for peace and a time for war and this has nothing to do with preference. So help us to engage in the battle, whether that battle is economic, for the family, for life, or one fought by American soldiers in a foreign land. We pray for protection, for wisdom and that we may persevere. Lord have mercy on our state and on our nation. May we be now, as we began, one nation under God, indivisible, with Liberty and justice for all. - Amen.”

The Speaker, on behalf of the entire membership of the House of Representatives, offered the following resolution:

House Resolution No. 458.

A resolution of tribute offered as a memorial for Donald E. Holbrook, Jr., former member of the House of Representatives and former judge of the Michigan Court of Appeals.

Whereas, The members of the Michigan House of Representatives and the legal community of our state were saddened to learn of the passing of Donald E. Holbrook, Jr. His long and accomplishment-filled life in public service set the highest standards of commitment. With his 8 years as a lawmaker and distinguished career in the judiciary, this gentleman exerted an impact on our state that will long benefit our citizens and institutions; and

Whereas, A native of Grand Rapids who earned degrees from Albion College and the Wayne State University Law School, Donald Holbrook answered his country’s call and served 4 years in the United States Air Force before embarking on a public service career that spanned 4 decades. First elected to the Michigan House of Representative in 1964, he was among the legislators faced with the major task of implementing the state’s new constitution. As chair of the House Judiciary Committee, he was integral in the enactment of the 1968 legislation creating the District Court; and

Whereas, Following his tenure crafting and voting on legislation, Donald Holbrook turned his intellect and talents to the real world application of the law as a jurist. After 2 years with the Circuit Court, he was elected in 1974 to the Michigan Court of Appeals, from which he retired in 2002. In addition to his outstanding efforts on the bench, Judge Holbrook was a leader with several commissions devoted to improving our state’s justice system. His thoughtfulness and thorough understanding of the impact the law has in our society earned him widespread respect across our state. Clearly, his life of service will not soon be forgotten; now, therefore, be it

Resolved by the House of Representatives, That we offer this expression of our highest respect to honor the memory of Donald E. Holbrook, Jr., who served our state with great distinction as a lawmaker and as a judge; and be it further

Resolved, That copies of this resolution be transmitted to Judge Holbrook’s family as evidence of the lasting esteem held for his memory throughout our state.

Dear Legislators:

Today I have signed Enrolled House Bill 5808, which makes appropriations for the Department of Transportation for the fiscal year ending September 30, 2009. However, I have disapproved one item pursuant to Section 19 of Article V of the Michigan Constitution of 1963. The specific item veto is contained in the attached copy of this bill, which has been filed with the Secretary of State.

This bill provides over $3.6 billion for rebuilding, repairing and maintaining Michigan’s roads and bridges, as well as key intermodal and public transportation programs. My action today:

• Provides over $2.7 billion in road and bridge construction funds to the Department of Transportation and local road agencies for the preservation, repair, and maintenance of Michigan’s transportation network.

• Provides $275 million for public transit programs, including $186 million for bus operating assistance grants to local transit agencies.

However, I have again disapproved Subsection (3) of Section 306which would mandate that the Department of Treasury develop a cost allocation plan for motor fuel tax collections based on time and effort.

I thank the Legislature for its work on this important budget bill.

THIS RESOLUTION IS OFFERED TO COMPLY WITH MCL § 18.1246.

House Concurrent Resolution No. 98.

A concurrent resolution to authorize construction and establish the total project cost of the Student Services One-Stop Center project at Muskegon Community College.

Whereas, The Muskegon Community College Student Services One-Stop Center project was approved by the Joint Capital Outlay Subcommittee as a self-financed project on September 6, 2007; and

Whereas, Muskegon Community College commenced construction on a portion of the Student Services One-Stop Center project in April 2008; and

Whereas, The Muskegon Community College Student Services One-Stop Center project was authorized for planning as a state project in 2008 PA 278; and

Whereas, Pursuant to section 246 of 1984 PA 431, as amended, the authorized cost of projects shall only be established or revised by specific reference in a budget act, by concurrent resolution adopted by both houses of the legislature, or inferred by the total amount of any appropriations made to complete plans and construction; now, therefore, be it

Resolved by the House of Representatives (the Senate concurring), That the Michigan Legislature recognizes the need to authorize construction and establish the total authorized cost to construct the Muskegon Community College Student Services One-Stop Center project at amount not to exceed $5,000,000 (State Building Authority share $2,499,900; State General Fund/General Purpose share $100; Muskegon Community College share $2,500,000); that the respective financing shares may be adjusted based upon the State Building Authority’s ability to finance the state share up to an amount not to exceed $2,499,900; and that the Legislature intends to continue to appropriate funds for construction subject to the limitations herein stated, in amounts not to exceed the authorized cost, subject to the ordinary vicissitudes of the legislative process; and be it further

Resolved, That a copy of this resolution be transmitted to the State Budget Director, the Director of the Department of Management and Budget, the State Building Authority, and Muskegon Community College.

Whereas, Over the course of his remarkable career as a member of the United States House of Representatives, John Dingell has exerted an impact that has strengthened our nation and safeguarded our people in many ways. His unprecedented tenure of leadership has had a profound impact in such fundamental policy areas as environmental protection, energy, health care, and commerce. The “Dean of the House,” Representative Dingell has amassed a record unparalleled in scope and depth; and

Whereas, John Dingell’s effectiveness in marshaling support among his colleagues for vitally important legislation is well established. He has been essential, as an author and co-author, in the crafting of many of the nation’s most important environmental and conservation laws. These included not only landmark legislation dealing with brownfield revitalization, safe drinking water, and hazardous and solid waste handling, but also lead exposure reduction, weatherization grants, and energy conservation; and

On July 17, 2008, the Governor signed into law Public Acts 232 and 233, establishing a divestment program for investments in Iran and Sudan. Under the new laws, the Department of Treasury is charged with the task of developing and maintaining a list of scrutinized companies for each country.

The Department was given 90 days from the effective date of the Acts to develop the scrutinized company lists. In addition, the Department is required by MCL 38.1133c(6) and MCL 38.1133d(6) to forward to the legislature a publicly available report that includes a copy of the scrutinized company lists within 30 days after the lists are created. Those lists are attached.
