House Resolution No. 392.

A resolution to memorialize the United States Congress to enact legislation to amend the Internal Revenue Code of 1986 (relating to alcohol used as a fuel) by adding the “Ethanol in TEOS Production Credit.”

Whereas, Section 40 of the Internal Revenue Code provides excise tax credits for the use of ethanol. Unfortunately, as it is currently written, Section 40 only provides excise tax credits for fuel ethanol. Companies that use ethanol as a raw material for commercial products are unable to qualify for the Section 40 tax credit; and

Whereas, Ethanol is an important raw material for various commercial products. Silbond Corporation in south-central Michigan, for example, uses ethanol to produce an important commercial product called tetra ethyl ortho silicate (TEOS). TEOS is used in U.S. Department of Defense applications, including the production of jet engines, integrated circuitry, and flat panel displays. Silbond is the only North American producer of TEOS; and

Whereas, Silbond and companies like it depend on the availability of ethanol at a reasonable price. United States commercial ethanol prices are rising because of an increased demand for fuel ethanol brought about in part through excise tax credits and other favorable government incentives. Rising commercial ethanol prices are hurting the bottom line of companies like Silbond that depend on commercial ethanol but are unable to qualify for the excise tax credits that are limited to fuel ethanol. The ability of these businesses to compete in the global marketplace depends on the availability of commercial ethanol at a reasonable price; and

Whereas, Michigan’s manufacturing economy is important to the region and the country. Silbond employs 63 people in the state of Michigan and is the largest corporate tax payer in Fairfield Township in Michigan’s Lenawee County. Helping Michigan to keep jobs in the state and to compete in the global marketplace is good for the Midwest region and the entire country; and

Whereas, The American Commercial Ethanol Fairness Act would expand Section 40 of the Internal Revenue Code to include commercial ethanol used in the production of TEOS. By allowing tax credits for the commercial use of ethanol, lawmakers can level the playing field and end the tax discrimination against commercial ethanol. This will enable more of our key businesses to retain jobs and compete in the global marketplace; now, therefore, be it

Resolved, By the House of Representatives, That we memorialize the United States Congress to enact the American Commercial Ethanol Fairness Act to provide a tax credit for commercial ethanol; and be it further

A concurrent resolution to request that the U.S. Fish and Wildlife Service extend indefinitely the depredation order for double-crested cormorants.

Whereas, The double-crested cormorants are dramatically depleting the public and private fishing industry throughout the Great Lakes and on inland lakes and streams. The destruction of the fisheries population is causing havoc to our recreational, tourist, and commercial industries; and

Whereas, The cormorants are also causing tree and vegetation destruction at an accelerated rate. The destruction is not limited to natural resources, but includes bridge and lighthouse deterioration. Public swimming beaches are being closed due to cormorant feces which poses a public health hazard in addition to its excessive and unpleasant odor; and

Whereas, The increase of the double-crested cormorant population has caused significant devastation to Michigan’s Les Cheneaux Islands, destroying vegetation and depleting the yellow perch population. The cormorant population increase is being reversed through the U.S. Department of Agriculture Wildlife Services reduction program which includes egg oiling. This program has led to improved fish reproduction and improvements in the fish populations; now, therefore, be it

Resolved by the House of Representatives (the Senate concurring), That we request that the U.S. Fish and Wildlife Service extend indefinitely the depredation order for double-crested Cormorants; and be it further

Senate Concurrent Resolution No. 29.

A concurrent resolution relative to secondary road patrol funds for cities and villages in all of Michigan’s counties.

Whereas, Section 76 of Chapter 14 of the Revised Statutes of 1846, being MCL § 51.76, as added by 1978 PA 416, permits secondary road patrol services to be provided by county sheriff departments to cities and villages. This section also provides that a secondary road patrol agreement is void if the city or village reduces the number of sworn law enforcement officers below the highest number employed at any time within the immediately preceding 36 months, unless the Michigan Legislature, by concurrent resolution, recognizes that the reduction was due to cuts in general services due to economic conditions; and

Whereas, Indeed, subsection (3) of MCL § 51.76 specifically provides, in part, that: “A concurrent resolution adopted by a majority vote of the Senate and the House of Representatives which states that the city or village is required to reduce general services because of economic conditions and is not reducing law enforcement services shall be presumptive that the city or village has not violated the strictures of this subsection”; and

Whereas, In all of Michigan’s counties, city and village general services have been reduced as a result of serious economic difficulties. These reductions in services have occurred in direct reaction to economic conditions; now, therefore, be it

Resolved by the Senate (the House of Representatives concurring), That cities and villages in all of Michigan’s counties have been required to reduce general services because of economic conditions and are not reducing law enforcement services as stipulated in section 76 of Chapter 14 of the Revised Statutes of 1846, as added by 1978 PA 416; and be it further

Resolved, That cities and villages in all of Michigan’s counties have met the necessary terms of their agreements for secondary road patrol services.

The Senate has adopted the concurrent resolution.
