     A bill to amend 1978 PA 368, entitled

 

"Public health code,"

 

(MCL 333.1101 to 333.25211) by adding section 21525.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 21525. (1) On or before February 1 of each year, each

 

hospital shall submit a report to the department summarizing the

 

number of hospital-acquired infections contracted by patients in

 

the immediately preceding calendar year. The annual report shall be

 

submitted on a form and in a manner as prescribed by the

 

department. The department may require any information considered

 

necessary for the surveillance, control, and prevention of

 

hospital-acquired infections.


 

     (2) The reporting form shall break down the number of

 

hospital-acquired infections contracted by patients within each

 

unit or department within the hospital. The reporting form shall

 

not contain the name of the patients, common identifiers such as

 

social security or driver license numbers, or other information

 

identifiers that would make it possible to identify in any manner

 

or in any circumstances the patient.

 

     (3) On or before March 1 of each year, the department shall

 

post on its website and otherwise make generally available a

 

summary of all information received from hospitals under this

 

section. The department shall include in the summary under this

 

subsection information regarding the number of hospital-acquired

 

infections for each hospital and for each unit or department within

 

that hospital. The department shall promote public awareness of and

 

increase knowledge about hospital-acquired infections and the steps

 

being taken by hospitals to prevent hospital-acquired infections.

 

     (4) The department may promulgate rules to provide for the

 

standards and procedures for the collection, analysis, and

 

reporting under this section of hospital-acquired infections and

 

for the preservation of the anonymity of each patient while

 

reporting the number of hospital-acquired infections to the

 

department.

 

     (5) As used in this section, "hospital-acquired infection"

 

means a nosocomial infection that is a localized or systemic

 

condition resulting from an adverse reaction to the presence of an

 

infectious agent or its toxin and that was not present or

 

incubating at the time a patient was admitted to the hospital for


 

medical treatment.
