A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
by amending section 16302 (MCL 324.16302).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 16302. (1) A person shall not sell or offer for sale in
this state containers connected to each other by a separate holding
device that is constructed of plastic rings unless the device is
degradable and bears a distinguishing symbol indicating that it is
degradable.
(2) A person shall not sell or offer for sale in this state a
disposable container for live fishing bait unless the bait
container is degradable and bears a distinguishing symbol
indicating that it is degradable.

A Before a manufacturer of container holding devices
that
are constructed of plastic rings who or a manufacturer of
disposable containers for live fishing bait sells or offers for
sale
or provides for the sale or offer for sale in this state of
these
devices shall design a distinguishing symbol indicating that
the
devices are degradable and shall register or bait containers,
the manufacturer shall do all of the following:
(a) Register the distinguishing symbol with the department.

provide
(b) Provide the department with a sample of the device or bait
container. The department may require

with
test data that show that the device is
degradable. as required
in
this part.

As used in this part, a separate
holding device does
not include a vacuum-packed wrapping that completely encases the
containers that it connects.
