A bill to amend 1986 PA 32, entitled
"Emergency telephone service enabling act,"
(MCL 484.1101 to 484.1717) by adding section 408a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 408a. (1) A public safety charge of $1.35 per month shall
be imposed on each service user.
(2) The public safety charge shall be collected in accordance
with the regular billings of the service supplier. The amount
collected for the public safety charge shall be paid by the service
supplier to the public safety fund created in subsection (3). The
public safety charge shall be listed separately on the customer's
bill or payment receipt.
(3) The public safety fund is created within the state
treasury.
(4) The state treasurer may receive money or other assets from
any source for deposit into the public safety fund. The state
treasurer shall direct the investment of the public safety fund.
The state treasurer shall credit to the public safety fund interest
and earnings from public safety fund investments.
(5) Money in the public safety fund at the close of the fiscal
year shall remain in the public safety fund and shall not lapse to
the general fund.
(6) Money collected and deposited into the public safety fund
shall be distributed as follows:
(a) 24.4% to fund the Michigan public safety communications
system.
(b) 9.3% to fund the Michigan commission on law enforcement
standards.
(c) 11.1% to fund the criminal justice information systems
established in the C.J.I.S. policy council act, 1974 PA 163, MCL
28.211 to 28.215.
(d) 1.9% to fund the prosecuting attorney's coordinating
council created in section 3 of the prosecuting attorneys
coordinating office act of 1972, 1972 PA 203, MCL 49.103.
(e) 6.6% to fund the bureau of fire services created in
section 1b of the fire prevention code, 1941 PA 207, MCL 29.1b, and
the firefighters training council created in section 3 of the
firefighters training council act, 1966 PA 291, MCL 29.363.
(f) 14.4% to support the traffic law enforcement and safety
fund created in section 819a of the Michigan vehicle code, 1949 PA
300, MCL 257.819a.
(g) 23% to fund the forensic science division of the Michigan
state police.
(h) 0.75% to support the crime lab of a police department of a
city with a population of more than 750,000.
(i) 0.75% to support 9-1-1 nonemergency diversion.
(j) 7.4% to support probation and parole monitoring systems.
(7) As used in this section:
(a) "Communication service" means a service capable of
accessing, connecting with, or interfacing with a 9-1-1 system by
dialing, initializing, or otherwise activating the 9-1-1 system
through the numerals 9-1-1 by means of a local telephone device or
cellular telephone device.
(b) "Service supplier" means a person providing a
communication service to a service user in this state.
(c) "Service user" means a person receiving a communication
service.
