     A bill to amend 1976 PA 451, entitled

 

"The revised school code,"

 

(MCL 380.1 to 380.1852) by adding section 1255a.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1255a. (1) Subject to subsection (2), beginning September

 

1, 2007, the board of a school district or intermediate school

 

district or board of directors of a public school academy that

 

provides health benefits for employees shall offer all of the

 

following as part of its health benefit package:

 

     (a) Health insurance with benefits that are comparable to the

 

most comprehensive health insurance offered by the board or board

 

of directors before September 1, 2007.

 

     (b) Health insurance with an annual deductible of at least

 

$3,000.00.

 

     (c) Health insurance with an annual deductible of at least


 

$3,000.00 and with a prescription co-pay of at least $50.00.

 

     (d) A health savings account plan. Subject to collective

 

bargaining obligations under 1947 PA 336, MCL 423.201 to 423.217,

 

the board or board of directors shall determine the eligibility

 

requirements, membership, amount of deductibles, qualifications,

 

and administration of the health savings account plan.

 

     (2) If a collective bargaining agreement that provides an

 

employee health benefit package is in effect as of the effective

 

date of this section for employees of a school district,

 

intermediate school district, or public school academy, and if that

 

health benefit package is not in compliance with subsection (1),

 

then subsection (1) does not apply to that school district,

 

intermediate school district, or public school academy until after

 

the expiration of that collective bargaining agreement.

 

     (3) As used in this section, "health savings account plan"

 

means a health savings account plan that complies with section 22

 

of the internal revenue code, 26 USC 22.
