SENATE BILL No. 1389

 

 

June 17, 2008, Introduced by Senator KUIPERS and referred to the Committee on Judiciary.

 

 

 

     A bill to amend 1927 PA 175, entitled

 

"The code of criminal procedure,"

 

(MCL 760.1 to 777.69) by adding section 23 to chapter XVI.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

CHAPTER XVI

 

     Sec. 23. Evidence based on a DNA sample or DNA identification

 

profile that is otherwise admissible in an investigative, pretrial,

 

trial, or posttrial proceeding is not rendered inadmissible because

 

the sample or profile was retained by the department of state

 

police in violation of section 6 of the DNA identification

 

profiling system act, 1990 PA 250, MCL 28.176, if it was retained

 

in good faith as described in that section.

 

     Enacting section 1. This amendatory act does not take effect


 

unless Senate Bill No. 1388                                   

 

          of the 94th Legislature is enacted into law.
