CONTENT
The bill would amend the Revised School Code to revise provisions for determining the date of an intermediate school district (ISD) election or a regular school election, pursuant to dates specified in the Michigan Election Law.
The bill is tie-barred to House Bill 4507, which amend the Michigan Election Law. Among other things, House Bill 4507 (H-2) would require a school district to hold its regular election for school board members on the general November election date, the odd-year general election date, or the even-year August general election date.
Under School Code, an ISD election must be held on the date of the regular school elections of its constituent districts or on a date determined by the ISD board under Section 642 or 642a of the Election Law. A regular school election or regular election (to elect a school board member in the regular course of the terms of that office) also must be held on the school district's regular election date as determined under Section 642 or 642a of the Election Law.
(In general, Section 642 requires a school district to hold its regular election for the office of school board member at the odd-year general election. If, on September 1, 2004, a district held its regular election on a date other than the odd-year general election, the district's school board may adopt a resolution to hold its regular election on one of the following:
-- The odd-year May regular election date.
-- The November regular election date in both even and odd years.
-- The May regular election date in both even and odd years.
Under Section 642a, after December 31, 2004, a school district's board that adopted a resolution to hold its regular election on a date other than at the odd-year general election may adopt a resolution to change its regular election to one of the following:
-- The odd-year general election.
-- The general November election.
-- The November regular election date in both even and odd years.
-- The odd year May regular election date.)
House Bill 4506 instead would require an ISD election or a regular school election to be held on a date as determined under Section 642c of the Election Law (proposed by House Bill 4507 (H-2)).
(Under that section, beginning January 1, 2009, a school district would have to hold its regular election for the office of school board member on one of the following:
-- The general November election.
-- The odd-year general election.
-- The August regular election date in even years.
After the effective date of House Bill 4507 (H-2), a district could not choose to hold its election on a November regular election date in an even year or an August regular election date in an even year without the prior approval of the school district election coordinator.)

FISCAL IMPACT
Because this bill simply would amend the Revised School Code to refer to a proposed section of the Michigan Election Law, which itself would revise guidelines and dates, there would be no fiscal impact. Any fiscal impact deriving from the change in election dates would be attributable to House Bill 4507.
