A SUMMARY OF HOUSE BILL 5363 AS INTRODUCED AND REPORTED FROM COMMITTEE 12-2-08

The bill would amend Section 80f within Chapter V of the State Aeronautics Code (2001 PA 225, MCL 259.80f) to correct a reference.  The act currently references 14 C.F.R. 107.1, a section that no longer exists in the Code of Federal Regulation.  The bill would correct the reference to 49 CFR 1540.5.

BACKGROUND INFORMATION:

The bill amends Section 80f within Chapter V of the State Aeronautics Code (2001 PA 225, MCL 259.80f).  Chapter V of the State Aeronautics Code governs the "regulation of aircraft, airmen, airports and air instruction."  Section 80f was added to the State Aeronautics Code by amendment in 2001 (2001 PA 225) to prohibit the possession of certain weapons within the "sterile area" of an airport.   The section provides criminal penalties for violations.

The section currently defines "sterile area" as that term is defined in 14 C.F.R. 107.1.  That section no longer exists in the Code of Federal Regulation.  The bill would correct the reference to 49 CFR 1540.5.

The bill makes a technical correction and has no fiscal impact.
