2. Amend page 4, following line 15, by inserting:
"CAPITAL OUTLAY
Sec. 501. The department of natural resources shall require local units of government to enter into agreements with the department for the purpose of administering the natural resources trust fund grants identified in part 1 of this act. Among other provisions, the agreements shall require that grant recipients agree to dedicate to public outdoor recreation uses in perpetuity the land acquired or developed; to replace lands converted or lost to other than public outdoor recreation use; and for parcels acquired that are over 5 or more acres in size, to provide the state with a nonparticipating 1/6 minimum royalty interest in any acquired minerals that are retained by the grant recipient. The agreements shall also provide that the full payments of grants can be made only after proof of acquisition or completion of the development project is submitted by the grant recipient and all costs are verified by the department of natural resources.
Sec. 502. Any unobligated balance in any natural resources trust fund appropriation made under part 1 of this act shall not revert to the funds from which appropriated at the close of the fiscal year, but shall continue until the purpose for which it was appropriated is completed for a period not to exceed 3 fiscal years. The unexpended balance of any natural resources trust fund appropriation made in part 1 of this act remaining after the purpose for which it was appropriated is completed shall revert to the Michigan natural resources trust fund and be made available for appropriation.".

A resolution proclaiming May 2006 as Hepatitis C Awareness Month in Michigan.
Whereas, It is estimated that 4 million Americans and 180,000 Michigan residents have been infected with the hepatitis C virus (HCV); and
Whereas, 75 to 85 percent of individuals infected with HCV go on to develop chronic infection, which can result in damage to the liver, end-stage liver disease, or death; and
Whereas, It is estimated that treatment for HCV-infected patients will exceed $13 billion by the year 2019; and
Whereas, Through treatment of the disease, approximately 50 percent of treated individuals may clear the virus from their body, and for others, risk of progression may be prevented or delayed through early detection and appropriate medical management; and
Whereas, HCV is a blood-borne virus and infected individuals may transmit it to others through sexual contact, from mother to child during the birthing process, occupational exposure to blood, or through injection drug use; and
Whereas, It is believed that the majority of people with HCV, including many infected through blood transfusions before 1992 or blood products produced before 1987, do not know they are infected, and many at high-risk for future infection are not aware of their risk and may not be knowledgeable about ways to prevent the spread of infection; and
Whereas, Increased public awareness and education about HCV, and the provision of a continuum of hepatitis-related services including prevention programs and testing and medical management/treatment programs, are needed to ensure the best possible health outcomes for individuals already infected with HCV and to prevent new infections; now, therefore, be it
Resolved by the Senate, That we hereby proclaim May 2006 as Hepatitis C Awareness Month in Michigan; and be it further

A resolution commending Detective Gregory T. Huggett of the Battle Creek Police Department for his valor, continuing achievements, and selection on May 16, 2006, as recipient of the National Association of Police Organizations' TOP COPS® Award.
Whereas, Detective Huggett joined the Battle Creek Police Department on February 29, 1988, and was promoted to the rank of detective in August of 1994. His assignments have included the investigation of burglaries, arsons, liquor establishment licensing and regulation violations, motor vehicle accidents, and assisting with the investigation of violent crimes such as armed robberies, assaults, criminal sexual assaults, and homicides; and
Whereas, During the last eighteen years with the Battle Creek Police Department, Detective Huggett has received ten Professional Excellence Citations, two Certificates of Commendation, one Meritorious Service Citation, and twenty-two Unit Citations, and in 1997, he was honored by the Michigan International Association of Arson Investigators as Arson Investigator of the Year; and
Whereas, Detective Huggett also currently serves as a member of the Battle Creek Police Department Emergency Response Team as a medic and is the chairman of the Executive Committee for the Police Officers Labor Council; and
Whereas, Detective Huggett has demonstrated courage and character throughout his career. Most notably, on May 9, 2005, the unfortunate day last spring an investigation of a brutal murder led Detective Huggett and his partner, Detective LaVern Brann, to an apartment close to the crime scene. Upon arriving at the apartment, Detectives Huggett and Brann encountered the panicked occupant trying to flee the scene, who then turned his gun on Detective Brann and killed him. Detective Huggett bravely continued to pursue the suspect and was himself shot in the leg during the gun battle that ensued. As a result of Detective Huggett's unwavering courage and determination, the suspect was captured before he could destroy any more lives; and
Whereas, On Friday, May 12, 2006, the National Association of Police Organizations paid tribute to Detective Huggett in Washington, D.C., at their Thirteenth Annual TOP COPS® Awards ceremony, in recognition of the professionalism and courage that Detective Huggett showed before, during, and after being shot during that fateful murder investigation; now, therefore, be it
Resolved by the Senate, That we hereby honor Detective Gregory T. Huggett of the Battle Creek Police Department for his valor, continuing achievements, and selection by the National Association of Police Organizations as recipient of their TOP COPS® Award; and be it further

Senator Sanborn's statement is as follows:
The Selepak case brought to light a number of startling facts about how the Department of Corrections operates. We have seen that on dozens of occasions, the department has disregarded its own policies, ignored Supreme Court rulings, and released dangerous criminals who should have been held in an effort to hide their own bureaucratic sloth. This approach to protecting the public ended with the deaths of an innocent couple and their unborn child in my district and the brutal slaying of a man in the Flint area. These crimes never would have happened had one person stood up in the Department of Corrections and said, "We do too important a job and have far too important a responsibility to cut corners." The only thing we heard from Corrections since then were excuses after the fact.
I recently received a newsletter which I assume went to all Corrections employees. It was titled "A Call to Action" and the first line said, "A major reorganization of the Michigan Department of Corrections is currently underway." For a moment, I was heartened. I expected to read about some real changes, and I thought the director would take the opportunity to remind her staff that if they are not doing their jobs, then they need to find another job. Sadly, what I found is that the only real change is that the position of administrator of the Office of Audit, Internal Affairs and Litigation which was being abolished, but all of the staff is being reassigned, many of them to the new Commission on Risk Assessment and Quality Improvement.
Now, folks, the Corrections ship is sinking, and not only are they shuffling the deck chairs, but they sent out a newsletter telling all of their employees that they have nothing to worry about as long as they don't mind that their chair may be moved to the other side of the ship.
It has become clear to me that two very dangerous attitudes now reign within the department. The first is a blatant disregard for the laws and policies of this state. The second is a lack of accountability for the employees within the Department of Corrections. The reality is this: Corrections was covering for the fact that they were not doing their job. We probably would have never known just how prevalent this problem is if not for the fact that innocent citizens of this state paid with their lives. The lack of accountability within the department is in my opinion, appalling. The director's solution is creating an internal commission, which will ask for ideas on how to improve Corrections from some 300 individuals within the department. You can ask 300 mechanics how to fix a flat tire, but until someone gets their hands dirty by changing it, you are still stuck in the same spot. At the end of newsletter, Director Caruso wrote "I have an obligation to my staff and to the citizens of this state to ensure public safety through strong and clear leadership."
Creating a quality control commission and shuffling the staff around is not going to solve the deep-rooted problems that run to the top of Corrections, and it is not leadership. Director Caruso, leadership is changing what's wrong and making it right, which means changing the attitude or personnel that are the root of the problem, not putting up some window dressing to divert attention. Leadership is not protecting your staff when they are acting inappropriately, by simply shuffling them to new positions. Leadership is telling everyone at Corrections that anyone cutting corners will face the consequences, something which isn't mentioned in your memo. Leadership is holding not only the members of your staff, but also yourself, responsible for what has happened. After reading your call to action, it is clear to me that real leadership is sorely lacking at the Department of Corrections, and I think this is far too important a matter to all of our constituents to let it continue.
Protest
Senator Allen, under his constitutional right of protest (Art. 4, Sec. 18), protested against the adoption of the conference report to Senate Bill No.242 and moved that the statement he made during the discussion of the bill on May 18 be printed as his reasons for voting "no."

Senator Allen's statement is as follows:
Being a representative and the Senator from the northern Michigan area, I, too, have a great deal of concern about this project. But we've been working closely with a variety of individuals and communities on this project. I ask that however this goes within this body that the voice of Walloon Lake is heard within its local units of government. We recognize that any of these projects is at times controversial, but there's been a broad-based discussion within the community on moving this project forward. If the body feels that it's more appropriate to move this in another bill, so be it, but there has been a significant amount of effort put forth by local units of government, local individuals to try and reach a consensus. I feel that this plan that has been put forth is very solid.
