SENATE BILL No. 1392

 

 

August 30, 2006, Introduced by Senators SCHAUER, SCOTT, PRUSI, BRATER, BASHAM, CLARK-COLEMAN, THOMAS, WHITMER, SWITALSKI, CLARKE, CHERRY, JACOBS, LELAND, OLSHOVE, EMERSON and BARCIA and referred to the Committee on Appropriations.

 

 

 

     A bill to establish the worker emergency fund in the

 

department of treasury; and to provide certain powers and duties of

 

the department of treasury with respect to the fund.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. This act shall be known and may be cited as the

 

"worker emergency fund act".

 

     Sec. 2. (1) The worker emergency fund is created within the

 

state treasury.

 

     (2) The state treasurer shall credit any amount received for

 

civil fines imposed under the workforce reduction notice act and

 

money or other assets appropriated, granted, or received as a gift

 

from any source for deposit into the fund.

 

     (3) The state treasurer shall direct the investment of the

 

fund and credit interest and earnings from fund investments to the


 

fund.

 

     (4) Money in the fund at the close of the fiscal year shall

 

remain in the fund and shall not lapse to the general fund.

 

     (5) The money in the worker emergency fund shall be used to

 

support programs that ameliorate the consequences for outsourced

 

workers, as follows:

 

     (a) To provide loan default insurance under the workers

 

supplemental protection act.

 

     (b) To provide tuition assistance to individuals meeting the

 

qualification for assistance under section 4a of the higher

 

education loan authority act, 1960 PA 77, MCL 390.1154a.

 

     (c) Not more than 10% of the money in the fund may be used to

 

provide direct outreach and education concerning the availability

 

of assistance through programs under the trade act of 1974, 19 USC

 

2101 to 2495.

 

     (6) For purposes of this section, "outsourced worker" means

 

adversely affected worker as that term is defined in 20 CFR 617.3.

 

     Enacting section 1. This act takes effect 90 days after the

 

date it is enacted.

 

     Enacting section 2. This act does not take effect unless all

 

of the following bills of the 93rd Legislature are enacted into

 

law:

 

     (a) Senate Bill No. 1236.                                  

 

         

 

     (b) Senate Bill No. 1237.                                 

 

         

 

     (c) Senate Bill No. 1161.
