SENATE BILL No. 741

     A bill to amend 2004 PA 46, entitled

 

"Public safety officers benefit act,"

 

by amending section 3 (MCL 28.633).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 3. (1) The public safety officers benefit fund is created

 

within the state treasury.

 

     (2) The state treasurer may receive money or other assets from

 

any source for deposit into the fund. The state treasurer shall

 

direct the investment of the fund. The state treasurer shall credit

 

to the fund interest and earnings from fund investments.

 

     (3) Money in the fund at the close of the fiscal year shall

 

remain in the fund and shall not lapse to the general fund.

 


     (4) The commission shall expend money from the fund, upon

 

appropriation, only  to  for the following purposes:

 

     (a) To carry out the purposes of this act.

 

     (b) To carry out the purpose of section 2 of 1937 PA 329, MCL

 

419.102.

 

     (5) The commission shall promulgate rules pursuant to the

 

administrative procedures act of 1969, 1969 PA 306, MCL 24.201 to

 

24.328, that prescribe standards and rules for the distribution of

 

benefits commensurate with the  purpose of this act  purposes

 

described in subsection (4).

 

     Enacting section 1. This amendatory act does not take effect

 

unless Senate Bill No. 740                                   

 

            of the 93rd Legislature is enacted into law.
