A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding section 17212.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 17212. (1) A person who is in the business of renovating
or demolishing any residential, industrial, or commercial structure
shall not place a mercury-added product into the waste stream
except under 1 of the following circumstances:
(a) As universal waste managed and disposed of under part 2 of
the hazardous waste management rules, R 299.9201 to R 299.9230 of
the Michigan administrative code.
(b) As hazardous waste managed and disposed of under part 111.
(c) By delivery to a take-back program established by a
manufacturer under section 17207(3)(d).
(2) A person who is in the business of renovating or
demolishing any residential, industrial, or commercial structure
shall keep a record of all mercury-added products that the person
places in the waste stream. A person subject to this subsection
shall, not later than January 31 of each year after the effective
date of the amendatory act that added this subsection, submit to
the department, on a form prepared and provided by the department,
a report of all mercury-added products, or components of mercury-
added products, placed into the waste stream during the preceding
calendar year.
