     A bill to amend 1978 PA 368, entitled

 

"Public health code,"

 

(MCL 333.1101 to 333.25211) by adding part 123.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

           PART 123. HEALTHY MICHIGANIANS BIOMONITORING PROGRAM

 

     Sec. 12301. This part shall be known and may be cited as the

 

"healthy Michiganians biomonitoring act".

 

     Sec. 12303. (1) As used in this part:

 

     (a) "Biomonitoring" means the process of measuring the amount

 

of synthetic chemicals in the body by examining, at a minimum,

 


blood, urine, fat, hair, and breast milk.

 

     (b) "Department" means the department of community health.

 

     (c) "Director" means the director of the department of

 

community health.

 

     (2) In addition, article 1 contains general definitions and

 

principles of construction applicable to all articles in this code.

 

     Sec. 12305. (1) The department shall develop a statewide

 

biomonitoring program that utilizes blood, urine, breast milk, and

 

other biospecimens, as appropriate, to identify the chemicals that

 

are present in the bodies of Michiganians, to investigate

 

relationships between specific environmental chemicals, toxicants,

 

and contaminants and geographic areas, and, in concert with other

 

concerned parties, initiate plans to minimize or eliminate exposure

 

to these chemicals, toxicants, and contaminants. The department

 

shall make available to the public for review and comment its

 

proposed protocol for accomplishing its duties under subsection

 

(2).

 

     (2) The department shall do all of the following:

 

     (a) Select the implementation sites for the biomonitoring

 

program.

 

     (b) Identify chemicals, toxins, and contaminants, to be

 

tracked.

 

     (c) Describe the purpose for tracking the chemical.

 

     (d) Choose the biospecimens to be utilized.

 

     (e) Determine the number of people to include in the pilot

 

program.

 

     (f) Design a sampling scheme and measurement method.

 


     (g) Collect and analyze the data.

 

     (h) Distribute the information to biomonitoring program

 

participants and the public.

 

     (i) Report to the legislature and assess the policy

 

implications of the findings.

 

     (3) The department shall, as it deems appropriate, work and

 

communicate with the department of environmental quality concerning

 

interagency information sharing and the synchronization of

 

environmental tracking and policy formation.

 

     (4) The department may create a subcommittee to advise and

 

assist the department in implementing and maintaining the

 

biomonitoring program in accordance with this part.

 

     Sec. 12307. (1) The department shall develop model protocols,

 

or program guidelines, that address the science and practice of

 

biomonitoring utilizing, at the least, breast milk, blood, and

 

urine in a manner that is participatory, community-based, and

 

involves representatives of the affected communities in the design,

 

implementation, evaluation, and communication of findings.

 

     (2) The model protocols shall include, but not be limited to,

 

guidelines for ensuring confidentiality, informed consent,

 

providing follow-up counseling and support where appropriate, and

 

communicating findings to participants of biomonitoring studies and

 

members of the affected and participating communities.

 

     Sec. 12309. The department shall design the biomonitoring

 

programs in a way that, to the maximum extent possible, the

 

collection of data accurately represents the socioeconomic, racial,

 

and ethnic population in this state, the collection of data

 


provides useful information about a range of Michiganians in a

 

variety of geographic areas, and the collection of data provides

 

information about trends over time.

 

     Sec. 12311. On January 1, 2010 and every 2 years thereafter,

 

the department shall provide a report to the legislature describing

 

a summary of activities conducted pursuant to the statewide

 

biomonitoring program, including findings and recommendations to

 

the legislature regarding the potential health impacts of synthetic

 

chemicals detected through the biomonitoring program and the need

 

for reductions in such chemicals. The department shall make this

 

report available to the public through its website.

 

     Sec. 12313. (1) The department, in administering this program,

 

shall seek funding, including state and nonstate funds, to support

 

the healthy Michiganians biomonitoring program.

 

     (2) The funding made available to the healthy Michiganians

 

biomonitoring program shall be available for all of the following:

 

     (a) Protocol development.

 

     (b) Training program development.

 

     (c) Education, resource, and outreach materials.

 

     (d) Advisory committee support.

 

     (e) Design and implementation of general biomonitoring

 

programs.

 

     (f) Design and implementation of a breast milk monitoring

 

pilot program.

 

     (g) Laboratory capacity expansion.

 

     (h) Normative data collection.

 

     (i) Program and data analysis.

 


     (j) Policy formulation.

 

     (k) Planning and evaluation activities.
