A bill to amend 1979 PA 94, entitled
"The state school aid act of 1979,"
(MCL 388.1601 to 388.1772) by adding section 105d.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 105d. (1) Not later than June 1, 2006, the board of each
district shall develop and implement a policy for considering
requests for approval for pupils who reside in the district to
enroll and be counted in membership in another district, as
provided under section 6(6). The policy shall provide for at least
all of the following:
(a) A hearing process that allows both the requesting parent
or legal guardian and the school administration the opportunity to
be heard before the board grants or denies approval.
(b) A process for a resident pupil who enrolls in another
district to return to the district of residence. This part of the
policy shall address a pupil's return in the event of expulsion
from the other district.
(c) If the district grants approval for a resident pupil to
enroll and be counted in membership in another district, the
approval is granted for the duration of the pupil's K-12 education.
(d) If the district grants approval for a resident pupil to
enroll and be counted in membership in another district, the
district shall also grant approval to a sibling of the pupil who
resides in the same household as the pupil.
(2) Not later than March 1, 2006, the state board shall
develop and make available to districts a model local policy that
meets the requirements of subsection (1) that districts may use to
develop their own local policy.
(3) This section does not apply to a district that is a public
school academy or university school, and does not apply to
enrollment of nonresident pupils under section 105 or 105c.
