A bill to amend 1978 PA 368, entitled
"Public health code,"
(MCL 333.1101 to 333.25211) by adding section 21529.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 21529. (1) Unless a flu vaccine shortage has been
declared causing a hospital to have an inadequate supply of the
vaccine in stock, a hospital shall, during the flu season, inform
each elderly person admitted to the hospital for a period of 24
hours or more that the influenza vaccine is available. If an
elderly person requests to be vaccinated against influenza and a
physician, physician's assistant, or certified nurse practitioner
determines that the vaccine is in the elderly person's best
interest, the hospital shall administer the vaccination to the
elderly person before he or she is discharged from the hospital and
shall document the vaccination in the patient's medical record.
(2) As used in this section:
(a) "Elderly person" means an individual who is 65 years of
age or older.
(b) "Flu season" means that period between September 1 and
April 1.
