     A bill to amend 2001 PA 142, entitled

 

"Michigan memorial highway act,"

 

(MCL 250.1001 to 250.2080) by adding section 76.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 76. (1) If a member of the immediate family of a person

 

who has died because of a car accident on a highway requests,

 

through a written application, the state transportation department

 

to install a memorial sign, the state transportation department

 

shall install a memorial sign at the requested location.

 

     (2) The state transportation department shall maintain the

 

memorial sign installed under this section. The state

 

transportation department shall approve a uniform design for

 

memorial signs under this section. The memorial sign will remain in

 

place for 5 years after it has been erected.


 

     (3) Private memorial signs that are erected before October 1,

 

2005 shall remain in place for 5 years after October 1, 2005 if the

 

state transportation department determines that they are not a road

 

hazard. After the 5-year period has elapsed, the state

 

transportation department shall hold the private memorial signs for

 

14 days to allow family members to retrieve them. If the state

 

transportation department determines that a private memorial sign

 

is a road hazard, the state transportation department shall remove

 

it immediately and hold it for 14 days to allow family members to

 

retrieve it.

 

     (4) After October 1, 2005, no memorial road signs shall be

 

erected except as permitted in subsections (1) and (2). If a

 

memorial road sign is erected in violation of this section after

 

October 1, 2005, the state transportation department shall remove

 

the sign and hold it for 14 days to allow family members to

 

retrieve it.
