SUBSTITUTE FOR
HOUSE BILL NO. 6294
A bill to make, supplement, and adjust appropriations for the
departments of community health and treasury for the fiscal year
ending September 30, 2006; to provide for the expenditure of the
appropriations; and to prescribe certain conditions for the
appropriations.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
PART 1
LINE-ITEM APPROPRIATIONS
Sec. 101. There is appropriated for the department of treasury
and certain other state purposes, as set forth in this part for the
fiscal year ending September 30, 2006, from the following funds:

PART 2
PROVISIONS CONCERNING APPROPRIATIONS
GENERAL SECTIONS
Sec. 201. Pursuant to section 30 of article IX of the state
constitution of 1963, total state spending under part 1 for fiscal
year 2005-2006 is $5,000,000.00. State payments to local units of
government under this act are $0.
Sec. 202. The appropriations made and the expenditures
authorized under this act and the departments, agencies,
commissions, boards, offices, and programs for which an
appropriation is made under this act are subject to the management
and budget act, 1984 PA 431, MCL 18.1101 to 18.1594.
DEPARTMENT OF TREASURY
Sec. 301. From the funds appropriated in part 1, the
department of treasury shall distribute the funds to the department
of community health to establish a statewide network of cord blood
stem cell banks and award grants to qualified stem cell banks. The
funds appropriated in part 1 are to allocate funds already
appropriated and do not increase the amount appropriated in section
88j of the Michigan strategic fund act, 1984 PA 270, MCL 125.2088j.
Sec. 302. The unexpended funds appropriated in part 1 for the
statewide network of cord blood stem cell banks are considered work
project appropriations and any unencumbered or unallotted funds are
carried forward into the succeeding fiscal year. If the funds are
carried forward, the department of community health is responsible
for expending the funds as provided in this act. The following is
in compliance with section 451a of the management and budget act,
1984 PA 431, MCL 18.1451a:
(a) The purpose of the project is to develop a statewide
network of cord blood stem cell banks.
(b) The project shall be accomplished by contract or state
employees.
(c) The total estimated cost of the project is $5,000,000.00.
(d) The tentative completion date is September 30, 2010.
DEPARTMENT OF COMMUNITY HEALTH
Sec. 401. (1) From the funds received under section 301, the
department of community health shall establish a statewide network
of cord blood stem cell banks and award grants to qualified stem
cell banks. The funds shall also be used to promote the statewide
network of cord blood stem cell banks and to increase awareness and
knowledge about the benefits of cord blood and stem cell research.
The funds may be expended for the department of community health's
administrative costs related to the administration of programs or
activities authorized under this section, but shall not exceed 5%
of the gross appropriation. The funds shall not be used for any
fixed capital costs, including, but not limited to, new buildings
or building additions. The funds appropriated in part 1 are to
allocate funds already appropriated and do not increase the amount
appropriated in section 88j of the Michigan strategic fund act,
1984 PA 270, MCL 125.2088j.
(2) The department of community health shall report by April
1, 2007, and annually thereafter, to the house of representatives
and senate appropriations subcommittees on community health, the
house and senate fiscal agencies, the house of representatives and
senate policy committees on public health, and the state budget
director accounting for the expenditure of the funds distributed in
accordance with this act.
