SUBSTITUTE FOR
HOUSE BILL NO. 5453
A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding section 52512.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 52512. (1) When the department evaluates acreage within
the state forest for purposes of management activities, the
department shall put up for timber sale all acreage meeting
silvicultural criteria that are designed to maximize forest
economics and forest growth within 18 months following completion
of the evaluation except for acreage restricted from harvesting
under state or federal law or requirements necessary to maintain
certification with sustainable forestry standards under section
52505.

(2) When the department puts timber sales up for bid as
provided in subsection (1), the department shall provide to all
bidders, for educational purposes only, the acreage included in the
timber sale that was identified by the department prior to the
effective date of the amendatory act that added this section as
containing factor limitations.
(3) Not later than October 1 of each year, the department
shall submit a report to the standing committees of the senate and
house of representatives that handle forestry issues that includes
all of the following:
(a) The total number of acres in the state forest that have
been identified by the department as containing factor limitations.
(b) The specific reasons for the factor limitations identified
under subdivision (a).
(c) Recommended actions to remove the factor limitations from
lands listed in subdivision (a) and return those lands to active
forest management.
(4) As used in this section, "factor limitations" means any
legal requirements that restrain timber sales within the state
forest on acres meeting silvicultural criteria that are designed to
maximize forest economics and forest growth.
