SUBSTITUTE FOR
HOUSE BILL NO. 5327
A bill to amend 1978 PA 368, entitled
"Public health code,"
by amending section 17221 (MCL 333.17221), as amended by 1993 PA
79.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 17221. (1) The Michigan board of nursing is created in
the department and shall consist of the following 23 voting members
who shall meet the requirements of part 161: 9 registered
professional nurses, 1 nurse midwife, 1 nurse anesthetist, 1 nurse
practitioner, 3 licensed practical nurses, and 8 public members.
(2) Three of the registered professional nurse members shall
be engaged in nursing education, 1 of whom shall be in less than a
baccalaureate program, 1 in a baccalaureate or higher program and 1
in a licensed practical nurse program and each of whom shall have a
master's degree from an accredited college with a major in nursing.
Three of the registered professional nurse members shall be engaged
in nursing practice or nursing administration, each of whom shall
have a baccalaureate degree in nursing from an accredited college.
Three of the registered professional nurse members shall be engaged
in nursing practice or nursing administration, each of whom shall
be a nonbaccalaureate registered nurse. The 3 licensed practical
nurse members shall have graduated from a state approved program
for the preparation of individuals to practice as licensed
practical nurses. The nurse midwife, the nurse anesthetist, and the
nurse practitioner shall each have a specialty certification issued
by the department in his or her respective specialty field.
(3) If more than 1 individual seeking appointment or
reappointment on or after the effective date of the amendatory act
that added this subsection meets the requirements of part 161 and
subsections (1) and (2) and the individuals have similar
qualifications, preference shall be given to the individual who
resides in, or is employed in, a health service area that is not
currently being represented on the board in order to broaden the
geographic representation on the board to include a representative
from each health service area and to maintain that geographical
equity. As used in this section, "health service area" means any
of the following areas in this state:
(a) Southeast, which consists of the counties of Livingston,
Macomb, Monroe, Oakland, St. Clair, Washtenaw, and Wayne.
(b) Midsouthern, which consists of the counties of Clinton,
Eaton, Genesee, Hillsdale, Ingham, Jackson, Lapeer, Lenawee, and
Shiawassee.
(c) Southwest, which consists of the counties of Barry,
Berrien, Branch, Calhoun, Cass, Kalamazoo, St. Joseph, and Van
Buren.
(d) West, which consists of the counties of Allegan, Ionia,
Kent, Lake, Mason, Mecosta, Montcalm, Muskegon, Newaygo, Oceana,
Osceola, and Ottawa.
(e) East, which consists of the counties of Arenac, Bay,
Clare, Gladwin, Gratiot, Huron, Iosco, Isabella, Midland, Ogemaw,
Roscommon, Saginaw, Sanilac, and Tuscola.
(f) Northern Lower, which consists of the counties of Alcona,
Alpena, Antrim, Benzie, Charlevoix, Cheboygan, Crawford, Emmet,
Grand Traverse, Kalkaska, Leelanau, Manistee, Missaukee,
Montmorency, Oscoda, Otsego, Presque Isle, and Wexford.
(g) Upper Peninsula, which consists of the counties of Alger,
Baraga, Chippewa, Delta, Dickinson, Gogebic, Houghton, Iron,
Keweenaw, Luce, Mackinac, Marquette, Menominee, Ontonagon, and
Schoolcraft.
