     A bill to amend 1931 PA 328, entitled

 

"The Michigan penal code,"

 

(MCL 750.1 to 750.568) by adding section 168a.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 168a. (1) A person who enters onto the property of

 

another person to window-peep in violation of section 167 or a

 

local ordinance substantially corresponding to section 167 is

 

guilty of a crime as follows:

 

     (a) Except as provided in subdivision (b), the person is

 

guilty of a misdemeanor punishable by imprisonment for not more

 

than 93 days or a fine of not more than $500.00, or both.

 

     (b) If the person was previously convicted of violating this

 

section, the person is guilty of a misdemeanor punishable by

 

imprisonment for not more than 1 year or a fine of not more than

$1,000.00, or both.

 

     (2) This section does not prohibit the person from being

 

charged with, convicted of, or punished for any other violation of

 

law committed by the person while violating or attempting to

 

violate this section.

     [Enacting section 1.  This amendatory act takes effect January 1, 2006.]
