CONTENT The bill would amend the Revised School Code to allow an intermediate school district (ISD) to provide services to constituent districts or public school academies before Labor Day under certain conditions.

Under the Code, the board of a school district or an ISD, or the board of directors of a public school academy (PSA) must ensure that pupils are not required to begin a school year before Labor Day. The requirement took effect on September 29, 2005. It does not apply under the following conditions:

-- If, on September 29, 2005, a collective bargaining agreement provided for a school calendar that was not in compliance with the requirement, the requirement does not apply to the district or PSA until the agreement expires.
-- If the district or PSA was operating a year-round school or program as of September 29, 2005, the requirement does not apply to the school or program.
-- If, as of September 20, 2005, the district or PSA was operating an international baccalaureate academy providing 1,160 hours of pupil instruction per school year, the requirement does not apply to the school or program.


Also, if a district or PSA begins operating a year-round school or program after September 29, 2005, it may apply for a waiver from the requirement.


The bill would require the board of a school district or ISD or the board of directors of a PSA to ensure that the district's or PSA's school year did not begin before Labor Day (rather than ensure that pupils are not required to begin a school year before Labor Day).


The bill would permit an ISD to provide programs or services according to a school district's or PSA's calendar if the ISD contracted with a constituent district or PSA to provide programs or services for pupils of that district or PSA, operated a program or service within a building owned by a constituent district or a PSA located within the ISD's boundaries, or otherwise provided instructional programs or services for pupils of a constituent district or PSA, and if the school district's or PSA's school year began before Labor Day as permitted under the exceptions described above.
