Kolb

In The Chair: Kooiman

The question being on agreeing to the title of the bill,

Rep. Hildenbrand moved to amend the title to read as follows:

A bill to amend 2003 PA 238, entitled "Michigan notary public act," by amending sections 5, 11, 13, 15, 17, 19, 21, 25, 31, 35, 51, and 53 (MCL 55.265, 55.271, 55.273, 55.275, 55.277, 55.279, 55.281, 55.285, 55.291, 55.295, 55.311, and 55.313).

The motion prevailed.

The House agreed to the title as amended.

Rep. Hildenbrand moved that the bill be given immediate effect.

The motion prevailed, 2/3 of the members serving voting therefor.

______

Rep. Kolb, having reserved the right to explain his protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

I voted 'no' on House Bill 6197 because a Republican sponsored amendment struck out the words 'domestic partner.' Under current law, parents and grandparents can notarize documents of their children and grandchildren, but not vice versa. To correct this discrepancy in the law, HB 6197 would prevent notaries from notarizing documents of their direct family members. Current statute does not allow a notary public to perform a notarial act for their domestic partner. The amendment added to this legislation now would allow this notarial act to be legal. This loophole is created because of a legislative attempt to strike out any reference of or recognize domestic partnerships in state statute. This closed-mindedness creates a loophole that defeats the original intent of the current statute.

I cannot standby and let the ignorance of this action go unnoticed. I find it mildly amusing and ironic that those who are supposedly so worried about 'special rights' are now creating 'special rights' through their attempt to eliminate any reference to families, e.g., domestic partnerships, that do not fit their narrow view of the world. The deletion of 'domestic partner' is a further attempt, in best light, to marginalize non-married couples, and at its worst, a homophobic action."

By unanimous consent the House returned to the order of

Motions and Resolutions

Rep. Hildenbrand moved to suspend that portion of Rule 44 requiring bills to be handed to the Clerk three hours prior to calling the House to order.
