1. Amend page 44, following line 13, by inserting:

"Sec. 21. Local units of government participating in the distribution of funds under section 17(4) shall use all or a portion of the funds to provide for adequate police, fire, and traffic protection of persons and property at and near each race meet, including areas where occupational licenses are required. Each local unit of government participating in the distribution of funds under this act shall show by a statement submitted annually on February 1 of each year to the racing commissioner the amounts of funds received and shall detail the expenditure of those amounts during the previous calendar year. The racing commissioner shall report annually to the governor and the legislature regarding these statements.".

Rep. Gleason moved to amend the bill as follows:

1. Amend page 2, line 16, after "state;" by inserting "to restrict certain political contributions;".

2. Amend page 46, following line 23, by inserting:

"Sec. 33a. (1) A licensee, a person who has an interest in a licensee, or the spouse, parent, child, or spouse of a child of a licensee or person who has an interest in a licensee shall not make a contribution to a candidate or a committee during any of the following periods:

(a) The term of the licensee's license.

(b) The 3 years following the final expiration or termination of the licensee's license.

(c) The period after the application for a license under this act until the license is denied or becomes effective.

(d) If the licensee first applies for a license under this act after the effective date of this section, whichever of the following periods before applying for the license is shorter:

(i) The period beginning on the effective date of this section.

(ii) The period beginning 1 year before applying for the license.

(2) A licensee, a person who has an interest in a licensee, or the spouse, parent, child, or spouse of a child of a licensee or a person who has an interest in a licensee shall not make a contribution to a candidate or committee through a legal entity that is established, directed, or controlled by any of the persons described in this subsection during the time periods described in subsection (1).

(3) If a contribution prohibited by subsection (1) or (2) is made by a person who has an interest in a licensee, the licensee is subject to sanctions under this act as if the licensee had made the contribution.

(4) As used in this section:

(a) "Candidate" means both of the following:

(i) That term as defined in section 3 of the Michigan campaign finance act, 1976 PA 388, MCL 169.203.

(ii) The holder of a state, legislative, or local elective office.

(b) "Committee" means 1 or more of the following:

(i) A candidate committee as that term is defined in section 3 of the Michigan campaign finance act, 1976 PA 388, MCL 169.203.

(ii) A political party committee as that term is defined in section 11 of the Michigan campaign finance act, 1976 PA 388, MCL 169.211.

(iii) An independent committee as that term is defined in section 8 of the Michigan campaign finance act, 1976 PA 388, MCL 169.208.

(iv) A committee organized by a legislative caucus of a chamber of the legislature.

(c) "Has an interest in" means that 1 or more of the following relationships exist between a person and a licensee:

(i) The person holds at least a 1% interest in the licensee.

(ii) The person is an officer or a managerial employee of the licensee.

(iii) The person is an officer of a person that holds at least a 1% interest in the licensee.

(d) "Licensee" means a person that holds either a racetrack license or a race meeting license under this act.

(e) "Managerial employee" means an individual who, by virtue of the level of remuneration or otherwise holds a management, supervisory, or policy making position with a licensee.

(f) "Officer" means either of the following:

(i) An individual who is an officer of a corporation, limited liability company, or limited liability partnership.

(ii) An individual who is a successor to an individual described in subparagraph (i).".

Rep. Hunter, having reserved the right to explain his protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

I rise in opposition to this legislation. While I understand and appreciate that racinos may benefit certain communities, I believe that irreparable harm would be done to Detroit's economy, in particular. Thus, I have several concerns:

1) The so called racinos could cost the City of Detroit up to $40 million a year in lost tax revenues-$20 million in lost gaming tax revenues, which the city could lose in reduced taxes paid by the three Detroit casinos. The racinos could take $161 million in revenues from the three Detroit casinos. Detroit could lose another $47 million to the other racinos. Also, $20 million or so could be lost in income and other taxes paid by workers laid off by the casinos. Further, Detroit hotels, restaurants and other businesses that benefit from the Detroit casinos will also lose.

2) The racinos seriously threaten development of the permanent casinos and Detroit's ability to host the 2006 Super Bowl. The three Detroit casinos based their permanent casino plans on economic models that obviously included no new casinos in other cities. New casinos could take more than $161 million from the three Detroit casinos, thereby totally changing those economic models. And that means that the casinos won't be able to build the hotels on their permanent development sites, which would jeopardize Detroit's bid to host the 2006 Super Bowl for lack of hotel room availability.

3) The racinos are counter to the wishes of Michigan voters: In 1996, Michigan voters approved three casinos for the City of Detroit - no more. In the past two weeks, two polls conducted by pollsters (Mitchell Research and MRG) have both found overwhelming opposition to the racinos. Opposition was overwhelming from Republican, Democratic and Independent voters. In the Mitchell poll, racinos were opposed 4-1 (77% to 19%). In the MRG poll, commissioned by former state Horse Racing Commissioner Bill Ballenger, racinos were opposed 66% to 25%. The Detroit News, Detroit Free Press, Flint Journal, Jackson Citizen Patriot, Lansing State Journal and Grand Rapids Press oppose the racinos.

4) While I appreciate the sponsors of this bill for providing consideration to Detroit to the tune of $30 million per year, there is no way to assure that these monies will be there from fiscal year to fiscal year - as we have already cut or have proposed to cut funds from the budget that we have previously committed to fund (i.e. $15 million for the public school 'reform' effort in Detroit. Far be it from me to suggest that this House would ever break a promise; however, racino funding promises can be broken at any time after we all have departed this chamber.

6) Further, even if the legislature provides remuneration to Detroit, as proposed, it does not come close to replacing the impact of losing casino jobs, and the spending those employees do in Detroit and other cities where casinos presently exist.

Therefore, for all these reasons I would urge my colleagues to join me in voting NO on the passage of this legislation."

A resolution to memorialize the Congress of the United States to enact H.R. 369, a bill to waive time limitations for the consideration of the Congressional Medal of Honor in a certain case.

Whereas, Congress has before it a bill, H.R. 369, that would waive time limitations specified in federal law to allow the Medal of Honor to be awarded posthumously to Sergeant Gary Lee McKiddy for acts of valor in the Vietnam War. This legislation was originated in response to circumstances surrounding the events of May 6, 1970, when a helicopter and crew came under intense fire and were shot down; and

Whereas, The helicopter's crew chief, Sergeant Gary Lee McKiddy, who compiled a remarkable record in Vietnam, gallantly rescued one crew member before Sergeant McKiddy was killed by an explosion that occurred as he returned again to the flames and wreckage to try to rescue the pilot. For a variety of reasons, including the fact that application procedures were not initiated prior to the statutory date of October 1975, Sergeant McKiddy's bravery was not recognized with the nation's highest honor. Congress considered similar legislation to address this in the 107th Congress but adjourned before taking action; and

Whereas, Congress has the opportunity to rectify the oversight of the past three decades to accord appropriate honor to a true national hero and defender of our ideals. This legislation is long overdue; now, therefore, be it

Resolved by the House of Representatives, That we memorialize the Congress of the United States to enact H.R. 369 to waive time limitations for the consideration of the Congressional Medal of Honor for Sergeant Gary Lee McKiddy; and be it further

Resolved, That copies of this resolution be transmitted to the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Michigan congressional delegation.

A resolution commemorating the Buick Motor Company on its 100th anniversary of doing business in Michigan.

Whereas, The Buick Motor Company was founded by David Dunbar Buick and incorporated in 1903; and

Whereas, The company has a rich and storied history in Michigan, moving in 1903 from its original location in Detroit to its longtime location in Flint; and

Whereas, Buick Motor Company emerged as a leader in U. S. automotive production in 1908 with 8,820 vehicles; and

Whereas, Buick Motor Company contributed to the efforts of World War I by building Liberty aircraft engines, mortal shells, ambulances and experimental tanks; and

Whereas, By the end of the 1920s, Buick Motor Company was General Motors' premium division and most popular seller; and

Whereas, Harley Earl was named head of General Motors' Art and Color Department, the first department of its kind in the industry and introduces the concept of clay modeling to automobile design, a technique still used today; and

Whereas, Harvey Earl's "Y Job" is recognized as the industry's first concept car; and

Whereas, As a result of the concept car, the idea of a "dream car" emerged within the industry as an essential sales and marketing device still used to this day; and

Whereas, Buick's standard turn signals were an industry first; and

Whereas, The post-war years spawned a classic era of Buick styling and technical innovation including: hard-top convertible styling, the dynaflow automatic transmission, and the vertical bar grille; and

Whereas, In 1948 Harvey Earl introduced the tail-fin to America; and

Whereas, In the 1950s, with their "aircraft styling," Buick Motor Company's LeSabre concept car set the design trend for America's "classic 50's" era automobiles; and

Whereas, In 1953, Harvey Earl's Motorama, the world's first auto show, debuts in New York City; and

Whereas, In 1958, Buick began a long-time commitment to golf by sponsoring the Buick Open in Grand Blanc; and

Whereas, In 1963, the Buick Special is introduced featuring the first U.S. mass-produced V-6 engine; and

Whereas, In 1974, Buick Motor Company introduces the fuel-efficient V-6, which became the premier engine in Buick's naturally aspirated, turbocharged, and supercharged versions; and

Whereas, By the year 2000, more than 35 million Buicks had been built since 1903; and

Whereas, The Buick Motor Company continues to be a leader in automotive sales as evidenced by its LeSabre model, the best-selling American full-size car for 11 years running; and

Whereas, In 2003, the Buick Motor Company celebrates its 100-year anniversary as one of America's premier automakers with a heritage that spans engineering milestones, the design and styling vision of Harvey Earl and the technological innovations of the 21st century; and

Whereas, Buick has had a tremendous influence on the course of American automotive history and a commitment to providing jobs in Michigan for so many years; now, therefore be it

Substitute for House Resolution No. 60.

A resolution to extend subpoena power to the House Education Committee and to its Subcommittee on Intermediate School District Review for the purpose of administering oaths, taking sworn testimony, and examining files and records regarding the Oakland County Intermediate School District.

Whereas, Full access to accurate information is essential for sound decision making by any public or private body. Section 1 of 1931 PA 118, being MCL § 4.101, provides that

Committees and commissions of or appointed by the legislature may by resolution of the legislature be authorized to administer oaths, subpoena witnesses and/or to examine the books and records of any persons, partnerships or corporations involved in a matter properly before any of such committees or commissions. Any witness who neglects or refuses to obey a subpoena of any of such committees or commissions, or who refuses to be sworn or testify, or who fails on demand to produce any papers, books or documents touching any matter under investigation, or any witness or attorney who is guilty of any contempt while in attendance at any hearing before any of such committees or commissions, may be punished as for contempt of the legislature.

Section 1 of 1952 PA 46, being MCL § 4.541, provides, in part, that

. . . any standing or select committee of the senate or the house of representatives, and any joint select committee of the senate and house of representatives, shall be authorized to subpoena and have produced before any such committee, or inspect the records and files of any state department, board, institution or agency; and it shall be the duty of any state department, board, institution or agency to produce before the committee as required by the subpoena, or permit the members of any such committee to inspect its records and files.

Pursuant to Rule 39 of the Standing Rules of the House of Representatives, the authority for a committee to issue subpoenas shall be granted by resolution, with the vote for adoption by record roll call and a majority of members elected and serving required for adoption; and

Whereas, Under the provisions of MCL § 4.83, a person guilty of contempt of the legislature shall be guilty of a misdemeanor and may, upon conviction, be punished by imprisonment in the state prison for not more than 5 years or by imprisonment in the county jail for not more than one year, or by a fine of not more than $1,000, or by both the fine and imprisonment in a county jail; now, therefore, be it

Resolved by the House of Representatives, That, pursuant to MCL § 4.101 and MCL § 4.541 and Rule 39 of the Standing Rules of the House of Representatives, we hereby grant subpoena power to the House Education Committee and to its Subcommittee on Intermediate School District Review in the context of the committee's investigation of the Oakland County Intermediate School District. The Education Committee and its Subcommittee on Intermediate School District Review may administer oaths, take sworn testimony, and examine records and files relative to the operations of the Oakland County Intermediate School District and exercise all powers provided for in MCL §§ 4.101 and 4.541; and be it further
