A bill to amend 1949 PA 300, entitled
"Michigan vehicle code,"
by amending section 819 (MCL 257.819), as amended by 1990 PA 168,
and by adding section 819a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 819. (1) Except
as provided in subsections (2) and
2 (3) subsection (2), revenue from the increases in
fees provided
3 in the 1987
amendatory act that added 1987 PA 232 and the 2003
4 amendatory act that amended this section is appropriated to the
5 transportation
economic development traffic law
enforcement and
6 safety fund and shall not be appropriated for any other purpose
7 in any act making appropriations of state funds.
8 (2) For the
fiscal year ending September 30, 1988, of the
9 revenue from the
increases in fees provided by the 1987
10 amendatory act that
added this section, $1,350,000.00 shall be
1 deposited in the state
treasury and credited to the general fund,
2 except that not more
than $500,000.00 shall be credited to the
3 gasoline inspection
and testing fund created in section 8 of Act
4 No. 44 of the Public
Acts of 1984, being section 290.648 of the
5 Michigan Compiled
Laws, and $100,000.00 shall be used during
6 either the fiscal year
ending September 30, 1990, or the fiscal
7 year ending September 30, 1991, for research of products derived
8 from corn grown in
this state for, but not limited to
9 transportation
purposes as described in section 9 of article IX
10 of the state
constitution of 1963.
11 (2) (3) For
the fiscal year ending September 30, 1989, and
12 each fiscal year thereafter, of the revenue from the increases in
13 fees provided in the
1987 amendatory act that added this
14 section 1987 PA 232, $2,500,000.00 shall be deposited
in the
15 state treasury and credited to the general fund, except that not
16 more than $1,000,000.00 shall be credited to the gasoline
17 inspection and testing fund.
18 Sec. 819a. (1) The traffic law enforcement and safety fund
19 is created within the state treasury.
20 (2) The state treasurer may receive money or other assets
21 from any source for deposit into the fund. The state treasurer
22 shall direct the investment of the fund. The state treasurer
23 shall credit to the fund interest and earnings from fund
24 investments.
25 (3) Money in the fund at the close of the fiscal year shall
26 remain in the fund and shall not lapse to the general fund.
27 (4) The department of state police shall expend money from
1 the fund, upon appropriation, only for 1 or more of the following
2 purposes:
3 (a) To enhance enforcement of traffic laws.
4 (b) To enhance the ability to provide safety on the streets
5 and highways of this state.
