                                                                                 A bill to amend 1982 PA 540, entitled                                             

                                                                                

    "Library of Michigan act,"                                                  

                                                                                

    by amending sections 4 and 5 (MCL 397.14 and 397.15), as amended            

                                                                                

    by 2001 PA 62.                                                              

                                                                                

                THE PEOPLE OF THE STATE OF MICHIGAN ENACT:                      

                                                                                

1       Sec. 4.  (1) A board of trustees of the library is created                  

                                                                                

2   within the department.  The board shall make recommendations to             

                                                                                

3   the department on the following matters:                                    

                                                                                

4       (a) The appointment of the state librarian.                                 

                                                                                

5       (b)  (a)  The services the library shall provide.                           

                                                                                

6       (c)  (b)  The manner in which the services shall be                         

                                                                                

7   provided.                                                                   

                                                                                

8       (d)  (c)  Other matters of general policy concerning the                    

                                                                                

9   library.                                                                    

                                                                                

10      (e)  (d)  The budget for the library.                                       

                                                                                


                                                                                

1       (f)  (e)  Proposed rules governing operations of the                        

                                                                                

2   library.                                                                    

                                                                                

3       (2) The board shall meet not less than 3 times per year,                    

                                                                                

4   including a meeting to be held in January of each year.  The                

                                                                                

5   board shall meet also at the call of the chairperson of the                 

                                                                                

6   board.                                                                      

                                                                                

7       (3) The board shall consist of the following:                               

                                                                                

8       (a) One member appointed by the speaker of the house of                     

                                                                                

9   representatives.                                                            

                                                                                

10      (b) One member appointed by the house of representatives                    

                                                                                

11  minority leader.                                                            

                                                                                

12      (c) One member appointed by the senate majority leader.                     

                                                                                

13      (d) One member appointed by the senate minority leader.                     

                                                                                

14      (e) The director of the department or his or her designee.                  

                                                                                

15      (f) A representative of the Michigan library association,                   

                                                                                

16  appointed by the governor from a list of 3 persons nominated by             

                                                                                

17  the Michigan library association.                                           

                                                                                

18      (g) Two members of the general public who represent users of                

                                                                                

19  the state library, appointed by the governor.                               

                                                                                

20      (h) One member who is a librarian from a college or                         

                                                                                

21  university library, appointed by the governor.                              

                                                                                

22      (i) One member who is a librarian from a public or private K                

                                                                                

23  to 12 system, appointed by the governor.                                    

                                                                                

24      (j) One member who is a librarian from a public library,                    

                                                                                

25  appointed by the governor.                                                  

                                                                                

26      (k) One member who is a librarian from a special library,                   

                                                                                

27  appointed by the governor.                                                  


                                                                                

1                                                                                (l) The chief justice of the supreme court or his or her                            

                                                                                

2   designee.                                                                   

                                                                                

3       (4) A member of the board appointed under subsection (3)(a)                 

                                                                                

4   to (d) shall hold office for a term of 2 years to coincide with             

                                                                                

5   the term of office of state representative.  Members appointed to           

                                                                                

6   the board by the governor under subsection (3) shall hold office            

                                                                                

7   for a term of 3 years except that of the members first appointed,           

                                                                                

8   3 shall be appointed for 3 years, 2 for 2 years, and 2 for                  

                                                                                

9   1 year.                                                                     

                                                                                

10      (5) The board shall prescribe rules for its own procedure.                  

                                                                                

11  Annually, the board shall elect from its membership a chairperson           

                                                                                

12  and vice-chairperson.  Members shall serve without compensation             

                                                                                

13  but shall be entitled to reasonable and necessary expenses                  

                                                                                

14  incurred in the discharge of their duties.                                  

                                                                                

15      (6) The state librarian shall serve as secretary of the                     

                                                                                

16  board.                                                                      

                                                                                

17      Sec. 5.  The governor,  in consultation with  after                         

                                                                                

18  receiving the recommendation of the board and with the advice and           

                                                                                

19  consent of the senate, shall appoint a state librarian who shall            

                                                                                

20  serve at the pleasure of the governor.
