A bill to amend 1966 PA 331, entitled
"Community college act of 1966,"
by amending section 157 (MCL 389.157).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 157. The
office of a member of the board of trustees
2 shall become vacant
immediately without declaration of any
3 officer or any
acceptance of the board of trustees or its
4 members, upon the
death of the incumbent, or his being
5 adjudicated insane or
being found to be mentally incompetent by
6 the proper court; his
resignation; his removal from office; his
7 conviction of a
felony; his election or appointment being
8 declared void by a
competent tribunal; his refusal or neglect to
9 file his acceptance of
office, or his refusal or neglect to take
10 and subscribe to the
constitutional oath of office and deposit
11 the same in the manner
and within the time prescribed by law; his
1 ceasing to possess the
legal qualifications for holding office
2 including his
residence qualification. If a
member of the board
3 of trustees fails or refuses to attend 6 consecutive regularly
4 scheduled meetings of the board without a valid excuse, the
5 remaining members of the board by majority vote may remove that
6 member and declare his or her office vacant as of the date of the
7 removal resolution. As used in this section, "valid excuse"
8 includes medical incapacity, an out-of-state work commitment, or
9 military service.
10 Enacting section 1. This amendatory act takes effect
11 January 1, 2005.
