A bill to amend 1949 PA 300, entitled
"Michigan vehicle code,"
by amending section 205 (MCL 257.205), as amended by 1980 PA
398.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 205. (1) The secretary of state shall maintain an
2 office in the state capitol complex, and in other places in the
3 state as the secretary of state considers necessary to carry out
4 the powers and duties
vested in the secretary of state. At
5 least
6 (2) Not less than 1 office shall be established in each
7 county of the state and in each city of the state having a
8 population of 10,000 or more, but not within a radius of 5 miles
9 from a county office
location. This subsection
10 (3) Notwithstanding subsection (2), if the population of a
1 city combined with the population within a 10-mile radius of the
2 city is 10,000 or more, the secretary of state shall maintain an
3 office within that city.
4 (4) Subsection (2) does not apply in a county having a
5 population of 300,000 or
more , nor or to contiguous cities
6 having a combined population of 10,000 or more.
7 (5) A person
licensed under section 248 , is not eligible
8 for appointment to conduct, manage, or be an employee of a branch
9 or fee office of the secretary of state.
10 (6) (2) A
bond may be required of a person in an office
11 established under subsection (1), (2), or (3) in an amount that
12 the secretary of state prescribes to cover the safe handling of
13 money received under this act. The secretary of state shall not
14 be held personally liable for a loss of money because of armed
15 robbery, larceny, embezzlement, riot, act of God, or other act of
16 a person resulting in a
loss of money which that is within the
17 authority and responsibility of the secretary of state as the
18 administrator of this act.
19 (7) (3) A
person appointed to conduct a branch office shall
20 receive compensation
fixed by the secretary of state , and
21 necessary expenses of the office. The compensation and expenses
22 shall be paid out of the Michigan transportation fund created
23 under section 10 of 1951 PA 51, MCL 247.660, and shall be
24 deducted from the fund before the fund is certified to the state
25 treasurer.
