A bill to amend 1984 PA 44, entitled
"Motor fuels quality act,"
(MCL 290.641 to 290.650d) by adding section 8a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 8a. (1) A motor fuel regulatory fee is imposed on all
2 refined petroleum products sold for resale in this state or
3 consumption in this state. The motor fuel regulatory fee shall
4 be deposited into the gasoline inspection and testing fund
5 created in section 8. This regulatory fee shall be charged for
6 capacity utilization of gasoline storage tanks measured on a
7 per-gallon basis. The regulatory fee shall be charged against
8 all refined petroleum products sold for resale in this state or
9 consumption in this state. The regulatory fee shall be 1/8 cent
10 per gallon for each gallon of refined petroleum sold for resale
11 in this state or consumption in this state with the per-gallon
1 charge being a direct measure of capacity utilization of gasoline
2 storage tanks.
3 (2) The department of treasury shall precollect regulatory
4 fees from persons who refine petroleum in this state for resale
5 in this state or consumption in this state and persons who import
6 refined petroleum into this state for resale in this state or
7 consumption in this state. The department of treasury shall
8 collect regulatory fees that can be collected at the same time as
9 the sales tax under section 6a of the general sales tax act, 1933
10 PA 167, MCL 205.56a, at that time.
11 (3) A public utility with more than 500,000 customers in this
12 state is exempt from any fee or assessment imposed under this
13 part if that fee or assessment is imposed on petroleum used by
14 that public utility for the generation of steam or electricity.
15 (4) The department of treasury may audit, enforce, collect,
16 and assess the fee imposed under this section in the same manner
17 and subject to the same requirements as revenues collected
18 pursuant to 1941 PA 122, MCL 205.1 to 205.31.
19 Enacting section 1. This amendatory act takes effect on the
20 date on which the state treasurer files with the secretary of
21 state a notice of final payment of all obligations lawfully
22 payable from the Michigan underground storage tank financial
23 assurance fund pursuant to section 21506(5) of the natural
24 resources and environmental protection act, 1994 PA 451, MCL
25 324.21506.
