A bill to amend 1951 PA 51, entitled
"An act to provide for the classification of all public roads,
streets, and highways in this state, and for the revision of that
classification and for additions to and deletions from each
classification; to set up and establish the Michigan
transportation fund; to provide for the deposits in the Michigan
transportation fund of specific taxes on motor vehicles and motor
vehicle fuels; to provide for the allocation of funds from the
Michigan transportation fund and the use and administration of
the fund for transportation purposes; to set up and establish the
truck safety fund; to provide for the allocation of funds from
the truck safety fund and administration of the fund for truck
safety purposes; to set up and establish the Michigan truck
safety commission; to establish certain standards for road
contracts for certain businesses; to provide for the continuing
review of transportation needs within the state; to authorize the
state transportation commission, counties, cities, and villages
to borrow money, issue bonds, and make pledges of funds for
transportation purposes; to authorize counties to advance funds
for the payment of deficiencies necessary for the payment of
bonds issued under this act; to provide for the limitations,
payment, retirement, and security of the bonds and pledges; to
provide for appropriations and tax levies by counties and
townships for county roads; to authorize contributions by
townships for county roads; to provide for the establishment and
administration of the state trunk line fund, critical bridge
fund, comprehensive transportation fund, and certain other funds;
to provide for the deposits in the state trunk line fund,
critical bridge fund, comprehensive transportation fund, and
certain other funds of money raised by specific taxes and fees;
to provide for definitions of public transportation functions and
criteria; to define the purposes for which Michigan
transportation funds may be allocated; to provide for Michigan
transportation fund grants; to provide for review and approval of
transportation programs; to provide for submission of annual
legislative requests and reports; to provide for the
establishment and functions of certain advisory entities; to
provide for conditions for grants; to provide for the issuance of
bonds and notes for transportation purposes; to provide for the
powers and duties of certain state and local agencies and
officials; to provide for the making of loans for transportation
purposes by the state transportation department and for the
receipt and repayment by local units and agencies of those loans
from certain specified sources; and to repeal acts and parts of
acts,"
(MCL 247.651 to 247.675) by amending the title, as amended by
1997 PA 79, and by adding sections 660p, 660q, and 660r.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 TITLE
2 An act to provide for the classification of all public
3 roads, streets, and highways in this state, and for the revision
4 of that classification and for additions to and deletions from
5 each classification; to set up and establish the Michigan
6 transportation fund; to provide for the deposits in the Michigan
7 transportation fund of specific taxes on motor vehicles and motor
8 vehicle fuels; to provide for the allocation of funds from the
9 Michigan transportation fund and the use and administration of
10 the fund for transportation purposes; to set up and establish the
11 truck safety fund; to provide for the allocation of funds from
12 the truck safety fund and administration of the fund for truck
13 safety purposes; to set up and establish the Michigan truck
14 safety commission; to establish certain standards for road
15 contracts for certain businesses; to provide for the continuing
1 review of transportation needs within the state; to authorize the
2 state transportation commission, counties, cities, and villages
3 to borrow money, issue bonds, and make pledges of funds for
4 transportation purposes; to authorize counties to advance funds

18 transportation funds may be allocated; to provide for Michigan
19 transportation fund grants; to provide for review and approval of
20 transportation programs; to provide for submission of annual
21 legislative requests and reports; to provide for the
22 establishment and functions of certain advisory entities; to
23 provide for conditions for grants; to provide for the issuance of
24 bonds and notes for transportation purposes; to provide for the
25 powers and duties of certain state and local agencies and
26 officials; to provide for the assessment and collection of
27 certain tolls; to establish certain duties of certain state
1 departments and local units in relationship to these tolls; to
2 provide for the making of loans for transportation purposes by
3 the state transportation department and for the receipt and
4 repayment by local units and agencies of those loans from certain
5 specified sources; and to repeal acts and parts of acts.
6 Sec. 660p. A toll may be imposed of $5.00 a vehicle on
7 visitors to a casino where gaming is conducted by a federally
8 recognized Indian tribe.
9 Sec. 660q. (1) If the toll derives from a highway under the
10 jurisdiction of this state, proceeds from the toll, minus the
11 expense of collection of the toll, shall be deposited in the
12 state treasury to the credit of the Michigan transportation fund
13 created in section 10.
14 (2) If the toll derives from traffic from a highway under the
15 jurisdiction of the county, city, or village, proceeds from the
16 toll, minus the expense of collection of the toll, shall be
17 distributed to the county, city, or village to be used for
18 highways under the jurisdiction of the county, city, or village.
19 Sec. 660r. The department or a county, city, or village may
20 construct and establish toll booths and erect barriers as
21 necessary to collect the toll on a highway under the jurisdiction
22 of this state, in the case of the department, or under the
23 jurisdiction of the county, city, or village, in the case of a
24 county, city, or village. Toll booths and barriers may be
25 erected on a road within 1 mile of the casino. The department
26 shall issue guidelines for the construction and operation of the
27 toll collection booths. A county, city, or village that decides
1 to erect 1 or more toll collection booths shall erect the toll
2 collection booths in accordance with guidelines issued by the
3 department and shall submit plans to the department, and, if the
4 plans submitted are in accordance with the department guidelines,
5 the department shall issue a permit allowing the county, city, or
6 village to construct and operate the toll collection booths
7 within 90 days of submittal of the application.
