A bill to amend 1986 PA 54, entitled
"Building officials and inspectors registration act,"
by amending section 10 (MCL 338.2310).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 10. (1) Performing instructional duties for
2 educational purposes and providing contractual inspection and
3 consulting services in construction code enforcement shall not be
4 considered conflicts of interest.
5 (2) An inspector shall not be permitted to inspect his or her
6 own work in a governmental subdivision. As used in this
7 subsection and subsection (3), "governmental subdivision" means
8 governmental subdivision
as defined in section 2(1)(t) 2a(1)(t)
9 of the Stille-DeRossett-Hale single state construction code act,
10 of 1972, Act No. 230
of the Public Acts of 1972, being
11 section 125.1502 of
the Michigan Compiled Laws 1972
PA 230, MCL
1 125.1502a.
2 (3) A governmental subdivision may establish additional
3 requirements and restrictions in the selection and hiring of
4 construction code enforcement officials, inspectors, and plan
5 reviewers.
6 (4) This act shall not be construed to limit or restrict the
7 type of internal administrative organization an enforcing agency
8 may choose, or to limit or otherwise affect the authority of the
9 enforcing agency to dismiss or suspend a building official,
10 inspector, or plan reviewer at its discretion.
11 (5) The inspection of schools that are operated by a school
12 district that is organized as a school district of the first
13 class under part 6 of the revised school code, 1976 PA 451, MCL
14 380.401 to 380.485, may be conducted by a fire department
15 determined by the commission to be designated as a class A fire
16 department. This subsection does not allow individuals
17 performing activities other than the inspection of these schools
18 to engage in the activities other than the inspection of schools
19 without being appropriately registered under this act.
